Bathroom comes with the house??!!

greencygnets · 29/07/2018 12:10

So DH and I have just bought a new house (not brand new but new to us :)) and it cost us a lot of money (far more than a care to admit! :))
We moved in yesterday, the house is perfect except for one thing...

They've taken the bloody bathroom with them!!!!

One of the two main bathrooms upstairs is literally empty, like I don't mean just the furniture which you obviously take with you. But they've taken the bath, sink and shower!!!!

The room is tiled but theres random pipes sticking out of walls where these things should be!! The only thing left is the toilet. I honestly don't know what to do... We were going to redo the bathroom anyway at some point but never told this to anybody and weren't planning to do so until at least November/December time but now we don't have a choice!!

The kids come home from the holiday with my in-laws on Tuesday and we've got no bathroom for them!!!!

AIBU to think that the bathroom comes with the house, or is it totally reasonable to take the bathroom with you to your new house??!!

Solicitor first thing tomorrow morning and take the bastards to the cleaners.

While I'm hugely indignant on your behalf, people did manage with one bathroom for decades!

TopShagger · 29/07/2018 12:25

It's perfectly normal. I'd have taken the toilet, too.

Every time I move house I usually take the roof tiles, all the radiators and most of the walls with me to my new house (they may come in handy)

When I move from the house I'm currently in I'm planning on taking the lawn as it's really rather nice.

DontCallMeCharlotte · 29/07/2018 12:29

What a bunch of wankpuffins! Although not much surprises me these days but this has (almost as much as when my sister went to pick up the keys to her new house and the previous owner was still in situ - he didn't realise he had to move out!).

First of all talk to your solicitor tomorrow (they will love to get their teeth into this BTW - conveyancing is normally so tedious!).

Secondly, you do have a bathroom for your kids. Just not the one you expected and you'll have to share for a while - like most of us used to. And at least there is a toilet in there which is the main thing.

HollowTalk · 29/07/2018 12:29

Think positively. It's clear you're going to win this case and you'll have the money off them for a new bathroom.

HollowTalk · 29/07/2018 12:30

@DontCallMeCharlotte, there was a thread on here a while ago about selling houses and it was quite common for the person selling not to realise he had to actually move out!

creddo · 29/07/2018 12:31

My sellers took the door handles, I'm now considering myself lucky.

HRHPrincessMegan · 29/07/2018 12:32

Outrageous. Did you fall out with them during the sale? Not that it would justify such a bizarre action. House moves and the ensuing stress can bring out the worst in people, or at least temper their rationality.

worridmum · 29/07/2018 12:32

You would be surpised at the number of people that dont read the legal pack or contracts they are signing.

My colleague had a client coming to our offices to engage us to take someone to court for taking the bathroom fitting range cooker and a couple of other expensive items. Even though it was written in big bold letters that these items were exptem from the fittings list and they had got a 5k discount on the purchasing price to account for this. The client was gobsmacked that they had taken the items they agreed upon....

Iamagreyhoundhearmeroar · 29/07/2018 12:33

Seriously, Hollow?? Does somebody with such limited understanding actually have the capacity to sign a contract? Confused

funnylittlefloozie · 29/07/2018 12:34

Lol, Topshagger!

I know someone who moved into a house only to discover that the vendors had taken the whole kitchen - cabinets, worktops, appliances, everything. I think they had left the sink and that was it. My acquaintances sued the vendors and won the cost of an entire new kitchen (which was apparently a lot nicer than the original one the vendor had taken with them!)

user1457017537 · 29/07/2018 12:35

I know someone who removed a fireplace and fittings, leaving a big whole. They had to bring it back. They are in breach of contract unless it was in the smalllprint but your solicitor should deal with this.

Iamagreyhoundhearmeroar · 29/07/2018 12:35

Of course they did. It’s an open and shut case. Hope op gets the same.

user1457017537 · 29/07/2018 12:35

hole sorry!

BlackAmericanoNoSugar · 29/07/2018 12:36

There are some countries where it’s normal to take the fitted kitchen with you when you move, but I’ve never heard of someone taking the bathroom.

DontCallMeCharlotte · 29/07/2018 12:36

HollowTalk I can believe it! Although in 20 years as a legal sec the only two late completions I had to deal with were hers and my own (buyers completed two weeks late).

greencygnets · 29/07/2018 12:37

We had to move on the Saturday, something with the previous owners going into a different county...

We thought the bathroom was included in the sale, it was apart of the all of the pictures and the contract as far as I am aware! Can they change it last minute without contacting us??

We left a message with the solicitors yesterday, but obviously weren't expecting anything back... we may have to just wait until Monday.

Funnylittle floozie
It is precisely for this reason that the vendors must now sign a fixtures and fittings form. It even includes things like the stairs.

Have you found the fixtures and fittings form op?

PeakPants · 29/07/2018 12:38

TopShagger me too. In fact, I might actually take the house itself as well. Or at least all the interior walls and the stairs.

Mummyoflittledragon · 29/07/2018 12:39

Cross post. They can’t change their mind. But you have to check the document first.

pigsDOfly · 29/07/2018 12:39

Not on the same level at all, but puzzling nonetheless.

I have a house that I let out. One tenant - awful person, sublet it, lots of damage, new fridge, new carpets needed for example and the house needed a complete renovation when I got it back - stole the locks off the 2 bathrooms upstairs and the downstairs loo.

HollowTalk · 29/07/2018 12:39

Yes, there have been a few threads where the poster has turned up with their removal van to find the sellers sitting there with everything still as it was on a viewing.

I think it's just those people who think the normal rules don't apply to them, though.

PeakPants · 29/07/2018 12:39

Oh and kick up a huge fuss. They need to pay compensation, which is good for you because you will get a new bathroom.
I can understand taking an aga or something, but not a freaking shower, sink and bath. Anything fixed stays unless agreed otherwise.

habibihabibi · 29/07/2018 12:40

I had all the kitchen cabinets including sink taken by the previous owners . Apparently it is common in Europe and the owners didn't know it wasn't the done thing in London.
Seemed odd as they only owned the flat for 2 years and had not fitted a new kitchen.
Got compensated and put it toward new cabinets.

Iamagreyhoundhearmeroar · 29/07/2018 12:41

I don’t like the sound of “as far as I am aware” and “it was in all of the pictures!”, Hmm

Just read the fixtures and fittings form, op.

AnxiousPeg · 29/07/2018 12:41

quite common for the person selling not to realise he had to move out

But... How? Just... how??

Not saying I don't believe you - I am just struggling to understand! Can you link to this madness?
