The thread continues....if it hasn't continued elsewhere! @Lateforall it was me who questioned Lobella loves depression wears lippy campaign. I get that the idea is that being a bit glam might be a way of coping. And i have been guilty of putting my face on to carry on in the world. I get that not everyone with pnd is sat at home in pjs unshowered with greasy hair. But I just find the whole thing so false on her account - maybe that is because I know of her in real life.

But I think so many of them have massivley over exaggerated aspects of their lives because it sells. Whether that is FODs clumsy parenting or whatever. But it really doesnt sit well

To be fair to whoever that Sam guy is, at least he seems grateful, over the moon and upfront in sharing it's a deal. Unlike half the petulant insta mums. If it should have #ad he should put it in but I'd far rather see someone delighted in their luck than doing us favours by reviewing unaffordable #ads

I come back to these threads and it’s just back and forth over often tiny insignificant things, it very much feels like a derailment. There is some interesting debate on here, but it’s so hard to find amongst the rest of it.

What is the purpose of Mercedes giving DLAM that car? Is it because Mercedes are such a kind and generous brand they give out cars for nothing? Or is it because they want DLAM to INFLUENCE her followers into thinking it’s a good product and potentially buying it? Of course it’s the latter. What is advertising if it is not influencing people to buy things. There is no doubt this should be labelled #AD and anybody saying otherwise is being deliberately obtuse or is just somebody who would start a row in an empty room

Never seen Mean Girls or I'd have got the connection. Seems a very unusual choice of username for this thread. Funny that on here it's 'bitching' and on Instagram it's perfectly acceptable.

DLAM’s loan car is interesting. Is it payment in kind to be loaned a car? Either way, she makes it clear it is a loan. The ASA guidance says “If the commercial intent isn't clear from the overall context of the communication, it should be labelled as an ad”. By marking it as a loan the commercial intent is clear so she doesn’t need to say ad too. (that was aug 17 guidance, maybe there is something more recent I haven’t seen).

Re Addresses- someone posted on this thread a very specific thing which made a bloggers address instantly googeable. The blogger herself had not (to my knowledge) revealed.

But it's a loan and a positive review. Whilst we don't know that she was asked to give a positive review, she wasn't loaned the car because Mercedes is kind. Surely that positive review - as opposed to a post with no comment - suggests it should be an ad.

My point was that I'm not actually sure they do have to use #ad as the posts themselves make it clear (to me anyway) that it is a promotion.

I tend to agree with the Merc post, the fact she has revealed the deal in place - they loaned her the car - makes it clear why she has posted a picture so she can probably get away without an AD tag as well. If she was required to do some SM posts in return then yes its a payment in kind - valued at either the value a hire car for that period would be, or her normal rate she would charge clients for the posts she put up.

The ASA says people shouldn't have to play detective whether ads are ads though. The fact I speculate about whether she was given the hotel room free or whether she paid for it, what the deal was on her Morocco visit, whether her topshop/M&S/H&M/ASOS clothes are gifted or she is paid to wear them as well (what does 'sponsored' mean?) etc etc shows she is rarely this transparent. There isn't even a disclosure policy on her website to refer to if you wanted to.

I read the MIC guy post that he had paid for the car. If he didn't it should be an AD, obviously.

@kirinm what I’m saying is that from my understanding of the ASA that is irrelevant as she has made the commercial intent clear. She says it was a loan - that is making it clear that she will have been leant it in exchange for mention(s) on IG. As long as that is clear she doesn’t have to say AD.

But @Sophia other posters have specifically stated upthread that what was obviously an ad to others was not in fact obvious to them and that in hindsight they felt duped. About other scenarios v similar to this DLAM Mercedes thing. Isn’t that the whole point of having regulation. It shouldn’t just be left up to people to figure out if they’re being sold to because some people won’t spot it. That’s one of the main points of this thread!

But my point is the commercial intent is not clear. It's a conditional loan surely? She gets leant the car and she posts something nice. A loan would be just her using the car maybe tagging them but not reviewing? She did that earlier anyway but for me, it's the added review at the end which takes it into the realm of AD.

Omg, seriously, no ones stupid enough (I hope) to think anyone thinks that Mercedes would loan or give cars to instagrammers, celebs or whoever for nothing in return. Of course they want that person to feature the car, be pictured in the car etc.

Imo the 2 people mentioned on here have made it very clear they're promoting the cars, they just haven't used #ad and from my understanding of the ASA guidelines, THEY DON't HAVE TO!!!!

@halfpast but in this specific scenario she has made it clear so in that specific instant it doesn’t matter that it isn’t also hashtagged ad. Hashtags are not compulsory.
