1. Men commit sexual assaults (NAM, etc).

2. Segregating toilets by sex means that men cannot go into female toilets (and are likely to be stopped if they try).

3. Segregating toilets by gender, otoh or saying "hey, use whichever one you feel like using" means that men can go into spaces where women are vulnerable (in this case toilets).

To put it even more bluntly: wherever men are not, sexual assault is less likely.

I think you are confusing sex and gender. I'm suggesting that toilets are segregated by sex. So if you are a biological male, it doesn't matter whether you are MTF, you still use the male toilet.

I bet you aren't as good at it as you think you are Katherina. There was a thread on AIBU not long ago which touched on this; I really don't think the line "I can tell the difference" will wash. It doesn't wash.

And an arrest? You can't be arrested for being in the wrong toilet! If you do something wrong you can be arrested for that, penis or not, but noone will be getting arrested and having a penis check if they haven't done anything wrong.

So here we are, back at the start, saying men who would lie to get into ladies' loos would have equal opportunity to do so were they segregated by sex or gender. So women are safer in neither scenario, but transpeople would be more comfortable with gender. That's the bottom line.

I know (and have known) a fair few MTF and FTM and I'm pretty good at telling. But of course there will be people who pass so completely that you won't necessarily notice in a casual meeting.

What has this niche scenario got to do with the broader issue? Noone is going to be checking bits before letting people into loos. Women are no more or less vulnerable to lying, predatory men in either sex or gender segregated loos, because in either case they could pretend to be something they're not to gain access. That being the case, the only reason to segregate by sex would be to make transgender people unconformable.

I think women are more vulnerable in mixed facilities, and I think mixed facilities are more open to abuse.

Who said anything about mixed facilities? As things stand there are men's and ladies'. Transgender people (I assume) use the toilet that best fits their gender identity. No women are any worse off, as we've just established. The end.
