So assuming the decision is put aside because it is unlawful(?), wrong(?), outside guidelines(?) to not contact all victims then would it go back to the same board or a different one
I believe it goes to a different board but don't quote me on that one.
But isn't that a long process and couldn't he argue that it doesn't meet the criteria for recharging him because of double jeopardy
The CPS normally makes charging decisions fairly quickly - around 9 days after the police refer the case on average. However, it could take significantly longer to get them to re-examine their decisions.
Double jeopardy does not apply in this case. He cannot be retried for any offence for which he has already been tried and acquitted unless there is compelling new evidence. However, charges that were dropped before trial can be reinstated and he can also be charged with offences that didn't get as far as charging previously.
