IMPORTANT: This could be a way for Trump to get an Attorney General who isn't recused from the Russia investigation, who could then rein in or fire Mueller. Sessions is recused but a new Trump appointee likely would not be.

Trump cannot appoint a senator. That would fall to the Governor of Alabama. In Alabama, a special election would be held and the governor has the option to appoint a replacement who would serve until that election is held.

Replacing senators who do not/cannot fulfill their terms is always done by that state, not by the Federal Executive Branch. In some states there is a special election, some just wait until the next scheduled election. In both cases that state's governor has the option to appoint a replacement to serve until the election.

cozie my understanding is that potus can appoint anyone for attorney general but they have to be confirmed by the senate. As the republicans control the senate, it would take someone really hideous not to be confirmed

I love that wikileaks might be responsible for planting the seed that don jr should have his emails out in the public (although he bypassed their suggestion to let them leak it to improve their credibility and just published them himself, guaranteeing that no one was the winner).

IIRC, he could during a 30 day (?) Congress recess, which was why they didn't really stop for more than a few days.

Yes I think he could skip the confirmation process if it was a recess appointment. It was what they were worried he might do before, as you say lweji. I don’t know if they ever go into recess at any other time apart from August.

The AG has to be confirmed by the Senate. But the President can do a 'Recess Appointment' and bypass confirmation, although the Senate must still confirm the candidate by the end of the next session of Congress. So, in essence a Recess Appointment would serve for up to 18 months. If they are not confirmed within that time, their appointment expires.

The Senate can block a Recess Appointment by not formally adjourning or by scheduling 'mini-sessions'. They did this in August to block Scrotus from making such appointments. They scheduled 'pro forma' sessions to take place every 3 days during August recess.
