I’ll just add I find this latest tweet quite disturbing. I was chatting with my teenage children yesterday about the political spectrum: left wing vs right wing, and authoritarianism and anarchy and all the shades in between. It was surprising what they knew. This step - control of the media - it is clear he is desperate to have. He probably doesn’t know it is fascist, but Bannon does.

He’s a a tweetstorm, but the only interesting one is this. It does reiterate the previous one, but it is threatening. Before talking about revoking licenses, he was raving about how fake news was unfair to him . The first license tweet then stated it wasn’t fair to the country; this one says it isn’t fair on the public. This is a tack he takes a great deal.

WASHINGTON—The Russian government used a popular antivirus software to secretly scan computers around the world for classified U.S. government documents and top-secret information, modifying the program to turn it into an espionage tool, according to current and former U.S. officials with knowledge of the matter.

The software, made by the Moscow-based company Kaspersky Lab, routinely scans files of computers on which it is installed looking for viruses and other malicious software. But in an adjustment to its normal operations that the officials say could only have been made with the company’s knowledge, the program searched for terms as broad as “top secret,” which may be written on classified government documents, as well as the classified code names of U.S. government programs, these people said.

1/ Today @politico reported DOJ refuses to confirm that Trump is a subject or target of the Mueller investigation.
2/ A “target” of an investigation is someone that the prosecutor intends to charge.
3/ A prosecutor often delays making that decision until late in an investigation, and the decision can change rapidly based on new info.
4/ A “subject” of an investigation is someone whose activity is within the scope of the investigation.
5/ Generally defense attorneys equate being a “subject” of an investigation with having potential criminal liability.
6/ People who aren’t “subjects” are often classified or referred to as “witnesses.”
7/ How a person is classified does not remain static over time. As a prosecutor finds out new information, a witness can become a subject.
8/ Along the same lines, a subject can rapidly become a target if the prosecutor develops new evidence.
9/ Typically prosecutors don’t tell someone their status until the investigation is complete, unless they are subpoenaed to testify and ask.
10/ Certainly the status of a person is not typically released to the public. Doing so could influence witness testimony.
11/ It could also lead to a defense argument that the government may have tampered with the jury pool to prejudice a particular person.
12/ So unless a prosecutor needs to reveal someone’s status—for instance, their attorney asks prior to testimony—it is not usually revealed.
13/ An exception is when a prosecutor wants to flip a witness. Mueller’s indication to Manafort that he is a “target” is an example of that.
14/ At this point, Trump is almost certainly a subject of the investigation because Mueller is investigating the Comey firing, which he did.
15/ That doesn’t mean he’s a target—in other words, that Mueller intends to charge him. And Mueller is unlikely to confirm this now. /end
