neighbours car has been in my garden for 3 months

first ever thread but I wanted some opinions from the outside

neighbours came to me in early May to ask if they can use our drive for two weeks, they bought their DD a car for her birthday as a surprise.
fair enough I thought no problem

the car is still there.

we don't want to cause tension with the neighbours because we all have to live here

my DD is 14 month and has just started to toddle so would like front garden back to make safe ( weeding, gates) for her to play in and I can sit on the door step whenever she wabts to venture outside.

we managed to catch him last week and told him we want to do our garden for DD (can't use back garden, subsided and v unsafe) and asked if he had an idea of when he was planning to shift his car

two months!!! we were quite shocked because he was very matter of fact, no apology etc and dp said "it's kind of taking the piss" and neighbour shrugged it off. it's the end of October...

aibu to want my garden back before October so I can let my DD run loose in her own space whilst we may still have sunny weather/ light evenings??
part of me feels selfish because we don't drive so don't have a car therefore a "drive way" in the literal meaning isn't needed. but our garden IS the drive way.

I'm quite timid and have no idea how to go about this whole situation so I was hoping some mumsnet opinions might help me figure out what to doGrin

OP, why do you think it's up to you to sort out the sinking back garden? You're renting. Don't invite the landlord to walk all over you just as the neighbour is doing!

right I'm back.

Neighbour did t answer door. his ndn said they thought he was in though. so I popped a note through which just says
"hi, the car you've parked on our driveway will need moving from the property by Sunday night at the latest. thanks"

so let's hope it works...

as for the garden

it's continually sinking. its just sort of slanted. landlord is v old lady who only uses post and we can only go through agent to contact her, who have to get permission. currently seen waiting 3 weeks for them to fill in the chimney as (to my horror) it was covered with a painted piece of cardboard and above that was rolls upon rolls of scrunched up tin foil all glued on. DD pulled the card down (it was very well disguised. I thought it was wood) lots of bits of bugs came down. still waiting for that

plus in our contract the upkeep of gardens is our responsibility

They are that cheeky they will try to talk you round, and you may be tempted to go oh ok another week/month! won't hurt.

I'm annoyed that they didn't answer the door. trying to give them the benefit of the doubt but their car and dog are there and windows wide open.
hopefully the letter should do the trick. I've taken a photo of it in case they say I never posted one.

question is now what if they just don't move it? what would be the next step?

Am shocked you need to ask. Get it towed. Tell him to move it. Does it have a SORN on it? If none of the above work/doable, then report him to DVLA. if it's uninsured and doesn't have a SORN then they'll deal with it.

yes glued on tin foil.
so there's a fire place shaped hole in the wall
on the "roof" of said hole was glossed white
I assumed was wood
DD pulled down, attached to the board was loads of food wrapping foil, tin foil, whatever you want to call it. loads of disintegrated bugs and muck came out
DP just taped a new piece of cardboard to it and it's taken us two weeks just to have the estate agents look at it. not heard back from them yet

Stick the reg number and make in there. There's on for the mot too. Iirc there's also one for insurance.

I wouldn't mess about any more. I'd ring 101 and report it as abandoned. He's had plenty of time to shift it.

It wouldn't need tax and MOT if it was SORN (someone may correct me on this, as am only 99% sure)

SORN means it's certified off road. But did read later on in your posts that they've been out in in a few times, so presume not on a SORN.

Could call DVLA if they don't collect it. As if it's uninsured, they will remove it and impound it (again only 99% sure - mainly from watching COPS ON CAMERA).

I would have thought the next step is another note Stating you were asked on (date) and agreed for 2 weeks and it has now been x weeks. As they are not answering the door when they seem to be in or responding to your note you will be contacted the Police (111) The citizens advice and a solicitor for advice.

It won't have SORN as you said you found out it was taxed - if it doesn't go by Sunday night and you don't want to confront them, write another note saying it will be towed first thing Monday morning and mean it (although I doubt it will get to that) - cheeky sod who has a driveway but uses yours - some people are completely unbelievable

Am I misremembering or did you say you checked and it was taxed? If so then it's unlikely to be SORN (apologies if I'm misremembering)

yes it's taxed and MOT done.
they're definitely home as windows now shut. definitely ignoring me.
I'm so glad I came for a kick up the arse and made this thread. feels good taking back my garden! hopefully I can make it look nice (and safe) before autumn!

This is the 2nd thread I've read today about CF's. I agree with pp something's not right. Your neighbour lives across the road but two up and has his own drive, plenty of space to park in front of his house but yet has parked his daughters car on your driveway since May Confused

I reckon they've defaulted on the loan for the car and declared bankruptcy.

I bet if you invite a scrap merchant round to tow that car, your neighbour will move like wildfire to come and move the car himself. Grin
