Okay so I wasn't going to post until I'd had some kind of resolution. However, planning called today to ask if they could access my garden on Friday as they need to do some "further investigation" and have another planning official who will be there to oversee it??

They wouldn't tell me over the phone what it was about (it wasn't Nice Planning Lady, it was someone I hadn't spoken with before)

Thanks pp for the thread title - which coincidentally was very apt!

No sign of CFN/ builders etc.

There's now a sign up saying
NO ENTRY IN TO PRIVATE GARDEN
CONTACT SOLICITORS NAME if you require further information.

I'd advise against doing anything that could be misconstrued as being 'aggressive'. If I was the CFN I'd be clutching at straws right now and one of those straws would be to paint you out as an evil garden guarding troll.

If I could do that and convince a judge that I needed to access the garden and the changes made it more possible to negate your aggression i might have a crazy chance of winning.

In addition I'd make sure to describe the window/door ambiguously referring to it as east facing opening and describing the work as a 30% enlargement of the opening etc.

Where they went wrong is they forgot to stick a 'lost cat' poster over the planning notice until the work had commenced

I don't think a case CAN be made for "needing" to access the garden. How do you make a case for "needing" something that belongs to someone else?

In any case, there chance that they signed the deeds without being made aware that a garden was not part of the deal is infinitesimal. In a set up like that, the seller would have to be very specific about what is and is not part of your property when you buy in there. I know Judge Judy would just scoff and tell them "you get what you pay for and you didn't pay for a garden", and bang her gavel.

So can we stop playing Devil's Advocate please? Because nine times out of ten, that's just a fancy way to say "I don't have a dog in this fight so I'm going to take the unpopular side and argue it just to get a rise out of people", and that is a level of twattery no one here needs.

Newdaddie how on earth would that case work? It's not like you need access to it to reach somewhere else/an easement of some kind. It's a private, enclosed garden. A judge would laugh you around all four corners.

Anyway, here's me flag/county shield/GAA type thing.
