Hi guys! Wow I've just had a chance to come back on and noticed the last thread is full already?!

There also seems to be loads of people saying they're over it and don't believe me. That's fine, I'm not going to get into an argument with anyone. I had no idea that I would get so many responses when I initially asked for advice on this situation, however, they have really cheered me up through what has been a really crappy few days at points. Thanks all.

Sorry if ive pissed people off.

Anyway my Grandma has landed at the airport and should be with me in a couple of hours. It's not even that far away (she likes to take her time) Grin

Letting the freeholder and managing agent about the Stop notice is important, if you haven;t already done so.
Just to reinforce that you can register with Land Registry to have details of any activity with any property eg solicitors enquiries, mortgage enquiries pinged to you immediately. You don't need to have an interest in the property. It does tell you which solicitor and mortgage company is involved. I suggest you do it just to make sure in case there is a possible sale.
By the by, if anyone is a landlord it is worth doing as it ensures no one tries to sellyour property while claiming it as their own!

Young couple knocking on doors to ask about the area sounds a bit odd to me!! Were you at home at the time? I wonder why they didn't knock on your door...

Some estate agents round by me do 'private viewings' before properties go on online. If the owners are developers (which seem most likely) they have probably put the word out in hopes of a quick sale. The estate agents ring anyone registered as being interested in that kind of property and hype them up to buy before it goes online. Don't know if it happens everywheybut definately seems to round here.

I agree with pp try and make it as obvious as possible there is a problem will put most buyers off!

And as for those that don't like the thread that's life. We all like different things as long as no one is breaking the rules there's nothing you can do so either hide it or stop moaning. There are lots of threads I don't like doesn't mean others have to stop enjoying them!

Hi Watty, delurking as someone who used to work in an estate agent - it's not uncommon for someone doing a place up to instruct an estate agent but say they can't take photos because the place is a mess due to refurb. So, they probably are waiting for it to be finished to get swanky photos done but giving out details to people already registered.

Yes, don't be afraid to tell any potential buyers of the issues. The CFNs aren't going to willingly disclose that they have issues with their neighbours and I have no idea how quickly any such issues from the planning department will actually show up in the searches. It may well be they're trying to flip it incredibly quickly before they do!
Also, as PPs have said, chances are it won't be formally listed yet until the flat is finished and photos can be taken. It doesn't mean it's not in the market though. Which estate agent did the CFNs buy it through? They will know the property well already so would probably feel quite confident to go ahead and market it to potential buyers they have registered with them.

Zoopla does an "historical" search of listings. I found the previous sale details, plus brochure, of a house I wanted to buy on zoopla

Estate/letting agents often send out details of properties before they get put on rightmove/Zoopla etc. Maybe that happened and this couple showed interest and so it hasn't bern advertised further yet.

It seems a bit strange that they knocked on nndn door and asked though. Is that a normal thing to do? And why didn't they knock on your door? All seems a bit odd.

I personally wouldn't panic about whether it's on the market or not. What difference does it make? The planning team are dealing with it as a priority. If it is for sale, or even for rent, any new occupier will have to deal with the consequences of last week's actions.

I've seen a few Buying a House guides that advise you to visit the area several times e.g. in the daytime to check school run parking and knock on neighbours' doors and ask them if they like living there, what the area's like generally. Then visit again at odd hours, at weekends, then random nights to check for parties, noise, gangs of yoofs roaming around, people removing listed building windows and putting in new French doors opening into their neighbours' gardens and general antisocial stuff.

I've never known anyone do that until just now, IF they were legit.

The notice will remain 'registered' against the land/property and not the person upon whom it is served.

So woe betide any potential new owners. I'd hazard a guess that the property's unsaleable in it's current condition. And the enforcement team will probably have tracked the owner.

Solicitor here.

Your solicitor is very likely to have got a land registry report for the property already -that's the first thing I'd do if a query came in of any nature regarding interests in land. It costs £6. It'll be on your solicitors bill so ask them what it says or to see it.

You can't just write to the land registry to ask them to let you know if anything happens. It's possible to put a restriction on a title but at a cost and not without first letting the owner have the chance to object.

The first thing for you to remember is that you are in the right here. It is your garden and any CFN trying to come into it would be trespassing. Put up a sign in FULL VIEW of the glass doors. If they let the property then the tenant will be miffed but that's not your problem. No one will buy it because as it's a listed building the seller would be legally required to state whether there had been any breaches. Any solicitor worth his salt would be able to unearth this issue if it came to it. Sit tight. I think the planning people will come good.

Could Lovely Northern Couple be CFN checking to see what people are saying to prospective buyers about the flat? If LNN forgot to mention that the door is illegal, as is access to Watts's garden, they might get pushier with their sale. What was silly NDN thinking??? Sheesh!!!
