Hello everyone, new thread as requested. hopefully MNHQ could be so kind (as they already have been) to verify that I'm the OP from the original four threads?

Sorry again about the title NO IDEA WHAT IS GOING ON ANYMORE but I will try to keep you all updated. I'll probably not be back till the morning but THANKS for all the support and nice messages Grin

I think you do need to make it clear to them that it's YOUR GARDEN!

The listed buildings thing may just have made them aware that PVC door frames aren't acceptable. Maybe they think it'll be ok if they replace them with something with a wooden frame... you do need to do something at this stage I think!

I'm seriously wondering if you should speak to your local police station, just in case something escalates. If the works they've done are a criminal offence then calling them might not be as unlikely as it may sound. If they're awful enough people to damage a listed building then goodness knows what else they're capable of. The planning department presumably don't work at weekends so maybe this work is deliberately being done over a weekend.

You need to be blocking their doors from opening now. Heavy planters, a bench - anything that stops them opening the doors into your garden. Nothing that damaged the doors - but makes them impossible to use.

Maybe add a tripwire across the length of their illegal door Wink

Add a sign - maybe in one of the heavy planters or on the back of the bench - facing the patio doors saying, "No entry. Garden private property of Flat 4 (? can't remember which number you are)"

Do you anything big and heavy you can put very close to the insitu patio doors? The fucking idiots then won't be able to open the bloody doors. Let your other neighbours know in case idiots try and go over their garden walls.

It may be worth speaking to the police about the ongoing trespass issues, even if only to make sure it's logged that you objected to this in case of later legal action.

I can't believe they have had the audacity to go into YOUR garden again!
You really need to put up some signage along the ilk of "trespassers will be prosecuted" and serve them a cease and desist! Please please get a solicitor- you can claim costs later down the line when it inevitably goes to court.

I'm astounded they have been back in the garden!

But please PLEASE contact a solicitor and post your own note through informing them that it is YOUR GARDEN and you will not tolerate anymore flagrant trespass onto YOUR PRIVATE property. Cover your own ass and make sure from day dot they are WELL aware it is YOUR garden- this will be very important later on "why miss Watt Did you not inform them from the offset it was your garden".....see what I mean?

I'm open mouthed at the gall they have had- also wondering why they would think a nicer set of doors will solve anything?

How dare Ken (I'm imagining him as Tom Hardy, btw - not because I think that's the most appropriate or best casting, but just because I have the hots for Mr Hardy) attempt to continue trying to conduct his business transactions in the light of such cheeky fuckery. Shock

On a serious note, if you don't want any further work to take place or have any tossers in your garden, I'd suggest you write a notice and tape it to the outside of the current doors. Then get someone to film the notice and you taping it on.

Photograph and/or film everything, btw - all evidence. Also, I wasn't entirely joking with my earlier suggestion of a camera to record what they're doing. Every time they step into your garden, they're trespassing.

As other people have said please put up signs and a note through their door saying you will prosecute for trespass.

Security cameras are the way forward here. If you need to go out tomorrow has someone got a dash cam or something similar you can borrow?? Obviously Ken isn't up to his keeping watch job.

The building work that has been done so far is illegal and in contravention of legislation protecting listing buildings - you did realise that this is a LISTED BUILDING, right???

You are breaking the law every time you do anything to this alteration. The planning dept. are aware and have put a notice through your door. You are also trespassing on my property - my private garden which is for my exclusive use - every time you open these doors and step out.

I have installed a camera which is recording my garden, and will therefore film you whenever you enter my private property. This film will be passed on to the relevant authorities.

Have they not breached the Party Wall Act?
It also sounds like it doesn't meet building standards.
If there are new doors there I think you need to ask them why they need patio doors to access land they are not entitled to.
You need to get a solicitor onto this first thing Monday, as joking aside this is pretty serious structurally. If nothing else they need a Party Wall agreement, survey, etc

In all seriousness I would post 2 letters through 1 addressed to the builders and 1 to the owners explicitly stating that they do not have any right to enter you garden and if they do you will be pursuing a case for trespassing!! As if they have received a letter from planning and still aren't stopping that's insane!!

New Doors?! That's mental. If they try to put in more acceptable doors and the planning people accept that (is that even possible?) then you may end up having to take your own legal action

No need to worry on that score Dumbledore there's no way the listed buildings officer will accept that. I lived in a listed building for over a decade and you need permission for everything, even things that seem quite minor like the colour you paint your door.

This just gets crazier! So the builders clearly want to complete the job even though what they are doing is illegal. I can't understand that. If I was them I would have run away and hoped I never got caught!!
