Good grief! In my (misguided) belief that most people are pretty decent, I would say they have got their wires crossed, presumed the garden is shared and ploughed on ahead thinking all is ok.
I would go with the calm approach first and see what happens. Escalate to planning if they will not rectify their mistake. Good luck!

Agree with Judas you should speak to the builders, don't let them carry on. How DID the builders access your garden? The whole thing sounds nuts. I am surprised the builders did it tbh, it sounds like a strange design, is it a bit like a centre parcs lodge or something where part juts out? Was the window even legitimate in the first place?

I second either a fence, or a wide flower bed right up to it.

Doesn't help in the short term though.

Definitely put a note through their door if they're not in & ask them to come to see you as soon as they get it.

You just bought your flat - Is it possible your landlord knew about a planning application/permission and didn't disclose? It should have come up on your searches though so unlikely I suppose. Checking recent planning applications on your postcode should be quite easy to do online.

Even if they are installing a juliet balcony / long window tha tcan't be opened into your garden, you need to go around NOW and tell the builders that they are not permitted to be in your garden and you will report them for trespass if they do not leave immediately.

Once they're gone, having secured their mess from the inside and removed every trace of rubble and dust from your garden, leave a photocopy of your land registry plan showing ownership of the garden for the neighbour and requiring (not asking or suggesting) that they immediately cease and desist from any activity on your land.

THEN - phone your local planning enforcement people - ours are amazing and shoudl be incredibly helpful.

That's awful! Does the door open inwards at all? If it does then perhaps they're planning on adding those little iron railings at the bottom like a mini balcony or something? Either way they're CF!!!
