@Wattyyyy did you get any photos of the builders name or company? Any before information you have would be very useful to the council especially if they decide to prosecute.

The owner will likely need to reinstate the window and stonework. This would be in a like for like basis. This could be a very expensive door...

It was a lovely (very old) curved sort of window with the black out doors either side

By the by, I can't picture this sort of window at all - and I really want to because it sounds nice!

OP check your contents insurance you may have legal cover, and if you do, get in touch with the lawyers for some advice

She doesn't need legal advice. If it's listed and no planning permission, then the planners will deal with him and deal with him fast.

well op sounds like the council are taking it seriously and will be out tomorrow. your neighbours are likely to have to rectify this.
unbelievable that they thought they could so this!! not only to access your garden but in a listed building too! id steer clear now nd let the council take care of it. fucking idiots!

Why do people buy lovely old buildings and then destroy the features that make them desireable? Just buy a modern plastic house if you have no regard for lovely old windows and shutters FFS!!!

They can't possibly think that no one would report them?! I mean even if they thought the land was communal (which is unlikely and why wouldn't they have checked first) how did they not know that the building was listed? It really sounds like they just don't care and are under the impression that they will get away with it.

Just saw your update OP - well done for getting onto planning. I'm so glad they are sending someone tomorrow. Such as shame they have demolished the brickwork and window but a good builder will be able to source some matching bricks and, hopefully, another window and put your lovely building back together.

I really hope the neighbours and the builders get a heavy fine for this.

I am not surprised you are fuming OP, this is unbelievable entitled fuckery from the neighbours, they MUST be at least aware of the listed building issues, even if they are accidentally ignorant of the status of the communal garden!

There is no such thing as a permitted development where flats are concerned. Report this immediately to the freeholder, Residents' Association (if one is in place) and Building Control/local authority. We're just coming to the end of a hellish 6 month dispute with an idiot couple in our building who turned their studio apartment into a 2 bed (ha) and encroached on communal space to make themselves a hall. Get in early! Save yourself a lot of grief further down the line.

Don't do any clearing up! You need to leave everything, all the broken stone, wood and ideally even the glass. The council needs to document everything. I would take photos of any materials left such as these.

The council will need this material to help determine what type of stone, wood and glass to insist on for the reinstatement.
