Parking wars - on my own drive !

I'm on half days this week and have just got home to find a car in my driveway. As we are a corner house we have two driveways, big enough for one car each. Parking is really tight around here and permit only too. Opposite us is 8 terraced houses with no allocated parking, so quite often they either park in their garages or in the handful or visitor bays opposite my place but in front of theirs. My front drive is VERY clearly my driveway.

Cheeky Fucker Neighbour (CFN) runs a business from home which involves a lot of clients coming and going from her house throughout the day (pet groomer) and he employs two people to help.

I came home today to find a car in my drive which was not DHs. So I park down the side (pink section) of the house on the road where neighbours park their cars. I go and knock on several doors to find out who it belongs too, turns out it's one of the employees who is staying for a little while longer (P/T). "But I'll only be another hour, so I'll move it then." I reply "No, move it now please as I have to unload my car." Person refuses and I end up leaving telling them to move it within 30 minutes.

That was an hour ago and when I knock on the door there is no answer.

My next door neighbour has just told me that this car is on either my front drive or rear drive each morning ! When he questioned them about it, apparently CFN has said it's OK for them to park there and they have cleared it with us. No they bloody haven't!

Thing is this went on last year but after words it sooner stopped but obviously they are doing it again.

I'm sat here glaring out my front window waiting for the fucker to move his car then we will have words. I would block it in, but the road is only wide enough for one car so would block the road.

Police and council will advise they can not move car as its private property. I would go down route of speaking to neighbour and advising that if not moved immediately you will be using local social media to let their customers know what sort of person they are. Sorry it's on of those situations where you need to install something to prevent people parking Sad

Yes it is trespass, but trespass is a civil matter. Trespassers may be sued, but not prosecuted. I learned that doing a law degree. Never learned that letting air out of tyres was theft though. And one of our profs wrote the theft act Grin.

Take photos as evidence OP and ask you neighbour who has told you the car often parks there to assist you by also taking photos whenever they notice that car on your drive. Ring 101.

I found this about running businesses from home.

It seems that you do not need much in the way of permissions, even with visiting clients.

You should be paying business rates if you have visiting clients and employees though.

Actually, if you have enough bricks, you don't even need to jack the car up, just build a wall with them behind the intruding car. It will take a while for them to take them down again! (Although you do run the risk that the stupid bastard might chuck one through your window but then you get to call the police on them anyway)

I am utterly raging on your behalf though - what the hell is wrong with people?! Bad enough they parked there at all, but actually refusing to move the car when you asked them to?! Deliberately stopping you from accessing your own property?! I don't even begin to understand that kind of mentality! Shock

I'd be going ballistic if someone had the actual brass neck to park on my drive and then refuse to move their vehicle when I asked them to. At that point I'd either be leaning on the doorbell and not moving until they'd moved their car.... or I'd be making a trip to the nearest B&Q.... by the time they came to move their car, there would most definitely be an obstruction in the way!

Definitely invest in signs that make it absolutely clear this is private property and parking is not permitted. Also put up a sign to the effect of anyone disregarding the signs and parking there does so at their own risk.... then put one of those spikey strip things across the drive way - if they drive over it and burst their tyres, tough shit - they were warned!

From a legal perspective - to cover your own arse, do nothing DIRECTLY to the car - be clever about it - obstruction is the way to go - or getting another party to tow the car.

Not much help, but:
If a vehicle is parked on your driveway without your permission, they would be trespassing. As trespass is a civil and not criminal offence the police will not always get involved. They can send an officer to try and determine the owner of the vehicle and ask them to move.
Unfortunately if you blocking them in would result in you blocking the public highway, this would be deemed a criminal offence, so you would be liable for prosecution.
Personally I liked the idea about putting their car up on bricks...
Also, I think investing in the bollards is the way to go in the future if your neighbour is going to behave so inconsiderately.
