the fact that his head might now be swollen makes it so sad, there are the parents thinking his head had grown when in fact it is oedema. but the parents are not listening Sad to GOSH but to people all over the world jumping on the band wagon

McTufty · 11/07/2017 09:23

This is a heartbreaking situation.

The very sad truth is that Charlie has a disease that is incompatible with life. I do not blame his parents for struggling to accept this. However the behaviour of "Charlie's army" who have been egging them on, providing false hope and suggesting GOSH are in some way trying to kill him has helped absolutely no one and is little short of reprehensible.

NormaSmuff · 11/07/2017 09:24

alltouched.
more early research was sent to parents, therefore taken back to high court.

MissHavishamsleftdaffodil · 11/07/2017 09:24

overview of judicial review:

www.google.co.uk/?gfe_rd=cr&ei=4YpkWY-bLo3W8AeY46OgBA&gws_rd=ssl#q=judicial+review&spf=1499761382286

I would guess it would focus on the parts about not taking all information into consideration - although it seems odd that a judicial review could be called when GOSH are following a judicial ruling in the first place?? Hoping someone with legal knowledge can explain?

GabsAlot · 11/07/2017 09:24

even if his head has grown wouldnt that be swelling rather than normal growth?

LovelyBath77 · 11/07/2017 09:25

I don't really understand why life support wasn't withdrawn after that extra weekend?

I think they asked for more time to say goodbye? Not sure either.

No matter what has happened with the head it still is the main question the judge has asked. have they new evidence or not?

Ellie56 · 11/07/2017 09:27

Maybe the parents started making noises about a judicial review before the letter was actually handed in?

DubiousCredentials · 11/07/2017 09:28

CA were asking last night if any of their members were Health Visitors so they could go and measure Charlie's head themselves and "do all the checks".

I have never witnessed ignorance like it.

NormaSmuff · 11/07/2017 09:29

The treatment suggested hasnt even been tested on Mice, let alone people/babies

MissHavishamsleftdaffodil · 11/07/2017 09:30

AFAIK there isn't much around the skull to swell, bone is close to the skin surface. Head measurements should be on the hospital records as they've been charting his weight and growth, and should be pretty cut and dried. Not sure if the skull size not growing means microcephaly being relevant to Charlie's case or whether the implication would be that if his skull isn't growing that his brain is also not growing and developing.

McTufty · 11/07/2017 09:32

misshavisham

I'm a lawyer but no expert on JR - I think though that what might have happened is after initial ruling, a JR was threatened against GOSH for deciding to withdraw life support given the 'new information'.

Judicial review is all about restraining unlawful exercise of power. I cannot see how you could judicially review a hospital for acting in accordance with a court order. They must have been suggesting something had changed since then the court order.

Happy to be corrected by someone with more public law experience than I have but those are my thoughts.

heavenlypink · 11/07/2017 09:33

Well said @RMC123

I'm in a similar position to you and I was thinking guilt is playing a huge part in this.

McTufty · 11/07/2017 09:34

And now GOSH have taken it back to court before Francis J for a further ruling, I cannot see that the JR can go anywhere. I think it was a threat to get GOSH to take it back to court for consideration of this new evidence.

MissHavishamsleftdaffodil · 11/07/2017 09:34

Thank you McTufty that helps.

nina2b · 11/07/2017 09:34

@Sirzy
Absolutely this is what is happening now.

Many thanks for the link to GOSH where the world's leading expert on mitochondrial diseases works. For anyone who hasn't read it, it is really clear and spells out all the other problems he has. The poor little boy has so many problems and no quality of life at all, he cannot even open his eyelids, he is being kept alive by machines, very sad.

user1489675144 · 11/07/2017 09:38

"In the Court of Appeal ruling, 25 May 2017, Lady Justice King said: “Charlie and his parents have the benefit of being treated at not only the centre of excellence that is Great Ormond Street Hospital, but of his having been under the care of a world-leading expert on mitochondrial disorders. I would wish to acknowledge the skill and care given to Charlie by the doctors and nurses at Great Ormond Street.”

I don't think the constant bashing of GSH helps and the protest group suggesting they are trying to kill a child is dreadful. They have done everything to keep him alive.

nina2b · 11/07/2017 09:38

CA were asking last night if any of their members were Health Visitors so they could go and measure Charlie's head themselves and "do all the checks".

With all due respect to health visitors, this is laughable - or it would be if it wasn't so pathetic.

Ellie56 · 11/07/2017 09:39

Unfortunately the parents have latched on to the treatment in America and built it up in their minds into something it isn't.

Rabbitnothare · 11/07/2017 09:40

Just posted on the old thread that someone has put up the direct email of the GOSH QC on the CA page and encouraging people to harass her now.

Alittlepotofrosie · 11/07/2017 09:40

I am so glad that the judge was so firm that he was acting in charlies interests and that he was not going to be replaced.

I suppose Charlie's Army think they are right and there is a chance of saving Charlie.
