In law, in England and Wales, it is.

In Scotland, there was (not sure if there still is) a not proven verdict. It would probably have been more appropriate in this case.

If I found a very drunk very young very vulnerable girl my first instinct would be to make sure she got home safely not rape her and call my friend to help and then buy my way out of it when I was caught out. But it's ok because she had had sex in the same position with someone else when she was drunk a few weeks previously. And that someone came forward when offered a substantial amount of money for his testimony.
