He didn't con his way in. He booked the room - he had a key! He did assume he could fuck her and he was right. She was an enthusiastic participant in a 3-way. It happens whether you want to believe it or not!

That is not my view at all. I think sex is private between two consenting adults and don't judge others on whom they have sex with.

I certainly judge people who have sex and leave their potentially dangerously drunk partner to fend for themselves while they escape out a fire exit - even if the sex itself was consensual.

You could take out all the sex and CE and co. still treated her like dirt.

I think you make a good point rufis that if her sexual history is fair game then his should be too, particularly if his history shows that he has form for targeting vulnerable young women who possibly are incapable of giving consent.

Check again. He booked the room. Either way, he was invited by his mate to the room and once in, invited by the girl to participate (according to him and his mate). She can't remember and so has left herself in an impossible position. You really can't 'prove' inability to consent unless you have medical evidence she was either dead or unconscious. She was clearly neither and so you can't convict. I have been drunk with a drunk women and both woken up with little memory of events - does that make me the rapist? Why not her?

'possibly incapable of consent' isn't the same as 'incapable of consent'. If it can't be proved, you can't convict. I don't agree with this - I have a daughter as well, but my advice to her is to be bloody sensible and avoid any situations where she doesn't have control around people she can't trust.
