This looks like a legitimate space right? Road markings to indicate it's a space, no signs anywhere saying no parking. Before I go to the bother of appealing, I wanted to get some second opinions.

I really don't think she does has a great chance. Not least because if it is a private carpark the appeals system isn't independent and is run by the industry body. Worth a shot but I wouldn't hold your breath.

The fact that other people parked there isn't a sign of confusion over the space. I'd suggest they are chancing it, or given the cost of the cars involved are rich enough to swallow up the fine as chump change.

The chipshop near my house is on a double yellow but the fact that between 5-8 there's a succession of cars outside it isn't any evidence whatsoever that there's confusion over double yellows. Just that they are ignoring a parking restriction.

But it isn't a private car park, it is a station one, and most likely governed by railway bylaws. The fact the ticket has been issued by a private company gives more chance that an appeal would be successful as they have to prove that they have the authority to issue tickets. I think there are other issues such as POFA not applying, so they cannot hold the keeper liable (i.e. if you don't disclose who was driving they can't just chase the car owner).

That is all the technicalities really. The moral side of the argument is perhaps more debatable. But my view on that is to always appeal because these parking companies are pretty all complete bastards.
