AIBU to contest this parking ticket? (pics included)

This looks like a legitimate space right? Road markings to indicate it's a space, no signs anywhere saying no parking. Before I go to the bother of appealing, I wanted to get some second opinions.

Sorry, agree not parking spaces.

Kidnapped · 18/05/2016 16:12

Sorry to agree with the crowd - they are not spaces.

The fact that no car could ever fit between the white line and the barrier is a clue to that. In your previous post you stated that "And it looks small in the pic but it's much bigger in real life and fits a car with plenty of space".

But the two cars shown are both parked about 2/3 over the white line. They can only get about a 1/3 of their cars into the actual 'space'.

BoomBoomsCousin · 18/05/2016 16:13

They don't look like spaces to me, since the other spaces seem to be marked as a whole bay, not just one line to park next to. Though since there are currently cars there it seems likely it's common for drivers to think they can park there and you may have grounds for appeal.

titchy · 18/05/2016 16:13

Clearly the Porsche straddles the white line? How on earth do think that straddling a white lane is parking within a bay?

There is what's left of a bay before the barrier was put in when the platform was extended but only a small bit remains.

Is that 'O.....t' station btw? Grin

CoolforKittyCats · 18/05/2016 16:17

But in that 'photographic evidence' of the bays not bring clearly marked there is photographic evidence of clearly marked bays. The cars parked where the op parked aren't in bays, it's obviously people who couldn't find spaces. There's not really any confusion tbh. I think they'd probably have a bit of a giggle at someone trying to say the op's original picture showed a parking bay.

^ agreed.

GeorgeTheThird · 18/05/2016 16:19

Nah, that's not a space. Sorry, OP.

AerithAngel · 18/05/2016 16:22

I have had 5 parking tickets in my life, none of which I have paid.
The one I did not get away with as went to the parking ombudsmen or whatever they are called, it was denied and I had to pay however when I called up to pay, It was TFL the woman on the phone was extremely rude to me. I made a complaint and as a good will of gesture they cancelled the ticket.
So yes ALWAYS appeal

Vaara · 18/05/2016 16:29

Is it a private car park belonging to the train station? And a private contractor who has given you the ticket?

In which case, you may well not have to pay either way.

LikeDylanInTheMovies · 18/05/2016 16:31

No way on god's green earth is that a space. The cars are at least 3/4 over the lines. They were chancing it just like you and you were unlucky enough to get caught.

I don't see that you've got any choice but to cough up and put it down to experience.

mumblesdad · 18/05/2016 16:32

Whilst I do not think that is a legitimate parking space, it is obvious that people think they can park there as seen on the photo. I would get a couple of photos showing different cars parking there over a couple of days and make an appeal on the basis that they have not defined the area as a No Parking area. It is their car park and they should clearly define the areas as parking bays or No Parking

It's also possible that they are making a fortune out of people who are parking in this area and then being ticketed.

firesidechat · 18/05/2016 16:43

So basically you chanced it and lost and those cars parked there today are also chancers. They will most probably get a fine too. I don't understand how you've got to this stage in your life and can't recognise a car parking space or lack thereof.

lougle · 18/05/2016 16:43

Your photo evidence shows that only half a car can fit in the marked area. It's not a parking space.

firesidechat · 18/05/2016 16:47

ah, yes. Now I see more of the layout and how the cars fit along those lines it is clear. Thanks.

They aren't spaces.

I did enjoy your post Arf.

Stillunexpected · 18/05/2016 16:50

Obviously not a parking space and I'm not sure that showing other cars parked there means that it is generally confusing, rather that there are lots of people who are willing to risk not getting a ticket if they park there!

Balletgirlmum · 18/05/2016 16:55

They are not spaces.

I often see cars parked in not proper spaces at my local station too. It's people who are desperate to park & they risk a ticket.

DailyMailFodder · 18/05/2016 16:57

Ahhhh, it's the old 'everyone else is doing it so it must be ok' rule. Grin

Sorry, but I still wouldn't have parked there even if there were other cars there.

No harm in appealing though.

meowli · 18/05/2016 18:06

We can all see that this is clearly not a space. However, given that:
a) there are no signs spelling this out,
b) the lines from the space it once was have not been obliterated,
c) it is obviously common practice to park there, and
d) parking there does not cause an obstruction,
I think you may as well appeal. I think the non-obliteration of lines is the strongest ground and leaves room for ambiguity (if not for a car!).

crankyblob · 18/05/2016 18:48

Op who has actually issued the parking fine? Is it council or a private firm?

crankyblob · 18/05/2016 18:51

Also how much is it to usually park there? Did you pay this charge?

alwaysfancywine · 18/05/2016 19:24

I think it's a private firm - CP Plus (?). Yes, I did pay the daily charge. (The ticket issued says its for parking in the wrong place).
Btw, I know the white lines are small but I thought it was markings a bit like these attached. Thanks everyone for your thoughts and suggestions - so helpful. I don't think i have much chance, but im going to give it a go. Will update!!

Agree with the above. Also - if the markings aren't spaces which to be fair they clearly aren't but anyway, why are they there at all? Entrapment, I tell you!

And finally OP, I'd appeal. Have a look online about how to do it. There are entire fora devoted to it. One really easy way of getting a ticket cancelled is if the issuing officer has taken down any details (eg your reg no) incorrectly. Hope you are let off!

flowery · 18/05/2016 19:44

Spaces have white lines either side of the car, not one white line underneath the middle of the car. Neither of the cars you've photographed are within a marked space, because the alleged 'space' is about two foot wide, therefore not big enough for a car.

crankyblob · 18/05/2016 19:45

Yes they are a private firm! They cannot take you to court only the land owner can! If they take you to court they must show that the fine is proportionate to the amount as if you had parked correctly ( or show how they suffered a financial loss) as there were no signs and you paid for a ticket they probably wouldn't bother.

To put your mind at rest, write an appeal notice to this firm stating the above points and pints from previous PP. You might not ever hear from them again!

Google the company in relation to this firm as there is plenty of information for you to help
