easy jet won't replace my ipad that they broke on the hold

I had a short flight with easy jet. However I was told as boarding the plane my hand luggage would have to go on the hold. I said I couldn't do this as was carrying delicate and fragile items (musical equipment). They told me I had no choice.

So I took on board what I could hold in my hands and the rest had to go on the hold. Every thing was fine apart from my iPad. Cracked screen so unusable.

I've been chasing them for 4 months and still they count it as resolved and won't replace it for me. Aibu to think that they should.

You do need travel insurance even just in EU. I will never put anything delicate in the hold again after watching Spanish baggage handlers KICK my Mums back with force down the belt when the belt stopped working Shock

My friend's ex is currently stuck on holiday waiting for their insurance company to work out an overground repatriation. Her partner's eardrum perforated on day 2 of a week long holiday and after discharge from hospital he can't fly. She's due back 5 days late at heaven knows what cost. Travel insurance is your friend.

In the current situation, OP has effectively chosen to self insure. Repair/replace/reconsider decision not to insure for future trips...?

Bloody hell you lot are harsh. Easy jet could easily decide to pay for it as a gesture and I'm amazed so many people don't think they should.

Mind you they dumped me in the wrong country once and refused to refund me so I can see you're unlikely to get anywhere....

Soup dragon- people transport delicate items every day of the week. Equipment for sports and business, delicate items being shipped here to buyers, all sorts. Of course they don't all turn up broken

Of course they don't because those items are properly packaged.

No one would put a delicate China vase in a suitcase and expect it to arrive intact.

I have never been on a flight where I would have been able to carry my necessary items in my hand, including iPad, kindle, phone, purse and travel documents. Even long haul.

I meant I have never been on a flight where I would have been unable to carry my stuff...

I'm not sure why the op is getting such a hard time here. If an airline damages luggage then of course it is liable, insurance is irrelevant. According to the op she was following baggage regulations and had to put hand luggage in the hold because there wasn't room for it in the cabin. So claims that it is her fault for not following guidance are a red herring. According to the op she told the staff that her bag had delicate things in it, and they told her it still had to go on the hold. So claims that easyjet had no way of knowing the item was delicate are a red herring.

Op, I presume you've followed the easyjet guidance about making a claim? If not you should exhaust their channels first. Make sure you wrote a clear account mentioning that you had complied with hand luggage guidance and that you informed the ground staff that there were delicate items in the bag and that you were told you still had to put it in the hold. If the company channels don't work, I'd advise tweeting, writing letters. You might also consider making a claim in the small claims court (cheaper for them to just settle so with luck you might not even have to go to court). If you get iPad fixed keep all documentation obviously. And any evidence about when it got broken (eg ask friend to write short statement saying they saw it not broken shortly before travel -- obviously only if they did, not suggesting lying).

The following conditions apply to all carriage of Baggage by Us:

16.5.1 in respect of Hold Luggage, We shall be liable to You for its destruction, loss or damage during the time it was in Our charge and to the extent that damage did not result from the inherent defect, quality or vice of the Baggage;

16.5.2 We shall not be liable to You for damage due to over-packing, damage to handles of all types, wheels, feet and pockets or for the loss of pull straps, security straps, and external locks.

16.5.3 We are not liable for any damage to Your Cabin Baggage to the extent caused or contributed to by Your negligence;

16.5.4 Our liability to You in respect of Baggage shall be limited to a maximum of 1,131 Special Drawing Rights per Passenger unless (a) it is proven that the damage resulted from Our act or omission or that of Our servant or agent and was done with intent to cause damage or recklessly and with knowledge that damage would probably result, and in the case of such an act or omission by a servant or agent, it is also shown that Our servants or agents were acting within the scope of their employment.

16.5.5 Special Drawing Rights shall be converted into the appropriate national currency as at the date of judgment or settlement.

16.5.6 We are not liable in any event in respect of loss or damage to Baggage which is not permitted to be carried pursuant to Article 20 (Dangerous Goods) or for any fragile, valuable, perishable articles or articles not packed in suitable containers that have been packed in Your Baggage contrary to the requirements of Article 19.12 (Baggage, Items Unacceptable as Baggage).

16.5.7 Our liability to you under 16.5.4 above shall be limited to a maximum of 1,131 Special Drawing Rights per Passenger unless a higher value (up to a maximum of £2500) is declared when dropping off Your Hold Luggage with Us and a supplemental fee paid according to our applicable tariff (see Fees and Charges), in which case our liability shall be limited to such higher declared value (subject to such higher sum being limited to the value of the Passenger’s actual interest in delivery at destination). A declaration can only be made at the time of travel at our Sales Desk or Customer Services Desk. We reserve the right to check whether any value declared adequately reflects the Hold Luggage content. We also have the right to provide proof, in the event of damage, that the amount declared was higher than the genuine interest at the time of delivery.

Plenty of wriggle room for EasyJet...

I always fold up a lightweight cotton tote bag in my carry on for just this reason. If my carry on has to be checked then my purse, kindle, water bottle phone etc can be chucked into the tote and stored under the seat in front of me. I've never needed to check my cabin bag but it's often handy to put those things in it anyway once I get on the plane so I don't need to get my case out of the overhead lockers during the flight.
It's really not easyjet's fault that you left it in there. They are very clear that bags over a certain size may have to go into the hold. It's also ver foolish not to have travel insurance even on short European trips. I tend to buy annual insurance because I like short breaks a few times a year. It cost about £20 this year and included extra natural disaster cover (trip to Iceland meant I though this was a good idea). If you were seriously ill abroad and needed repatriation would your family be able to sell your assets to cover the costs?! If you were killed how long would it take them to sell your assets and cover the costs? It sounds like it would be very stressful for your loved ones.

Unless you opened the freshly-delivered case and discovered the cracked iPad under the supervision of an member of Easyjet staff, this claim is going nowhere. There is no evidence that they broke it. It could very easily be a malicious claim. I'm not saying you're making it up, OP, but why would they believe you?

The only thing you can hope for is a goodwill gesture, and it doesn't seem like they're budging on that either.

Travel insurance, on the other hand, would have been far less problematic to claim from.

Fuzzy wizard the ops luggage wasn't too big for the cabin. She was not allowed to take any hand luggage on with her. The cabin was full Before she boarded.

Why are so many people missing that? It's obvious from the OP.

How much can you carry in your hands? Hmm

Yeah I agree that there's a lot of selective reading going on here. I think that the point is that the op was within her rights to expect to be able to take her luggage as hand luggage (it was within the regulations) AND she informed the ground staff that the luggage was delicate and they still insisted she must put it in the hold. I'd be very surprised that if this were to go court (which it probably won't) it wasn't held that in telling her she had to put her delicate items in the hold despite being entitled to expect she could take them on the plane, easyjet had assumed responsibility and a duty of care for the delicate items, despite contractual terms saying they did not take responsibility.

Ilove- easyjet have two categories of hold baggage- the smaller category is guaranteed to stay with you in the cabin. Baggage that is larger than this but still within cabin-allowed dimensions may be put into the hold. Several people have pointed this out and I'm not sure what it is you're not getting about this.

That's because her bag was clearly cabin-allowed rather than cabin-guaranteed size. It states clearly on their website that this can happen to your bags. I always make sure I have a small cotton tote in my carry on because it's bigger than guaranteed size. DP takes a guaranteed size bag so doesn't need to worry about it. They even have two separate measuring baskets- if your bag fits in the smaller one you will never be asked to put it in the hold.

Again, the OP has said her bag was not too big to go in the cabin. Unless you're saying she's lying? I'm not sure why you're assuming you know better than her what size it was?

Cabin-allowed baggage is not too big for the cabin... And if they have to check it then they do so free-of-charge whereas if your bag is too big for the cabin you will be charged to check it. The smaller sized bags never have to be put in the hold. I've flown with easyjet quite a bit since the new regulations came in.
