To be totally baffled (Ched Evans related)

Just reading in the guardian that Ched Evans has applied to the Criminal Cases Review Commission to review his case. That's fine because it is part of our due process and legal system.

However, in the article it points out that his girlfriend's father is paying for appeal barristers, private detectives and even offering a reward for information in order to help his appeal. Why would you do that? Why would you put up so much money to protect a person who at best (from their perspective at least) cheated on your daughter in a rather deplorable fashion and at worst a rapist? Why would got want your daughter to be with such a person?

I really don't understand.

As MEOD said, there was no accusation at all. She woke up and couldn't remember what happened. It was the police who figured out what had gone on and began the investigation.

It is extremely difficult to get a rape case to court, much less to secure a conviction. The fact that this case went all the way to court, and resulted in a conviction means that the evidence was solid and the police were convinced there was a case to answer.

He was convicted on the evidence, do you know how hard it is to get a conviction for rape? He is a rapist and has no grounds for appeal.

I'd be pretty shocked if my council employed bin men without a dbs check to be fair. People get sacked from jobs every day due to criminal behaviour and it's ludicrous to suggest that a non-sleb convicted rapist would be automatically walking back into whatever job they held after over 2 years inside.

Ugh if you read any of the responses he gave to the questions he was asked in court it is blatantly clear that he didn't disagree with what the prosecution was saying but that he felt he was entitled to behave that way and couldn't really understand what the fuss was about. It makes for truly awful reading. In the original investigation he entirely dropped himself in it because he didn't understand that it was wrong to use the body of an unconscious woman - he felt that that behaviour was entirely ok.

What makes this case truly horrible is that it is absolutely certain that his friend texted him and he went to the room to have sex with an extremely drunk girl that he had never met. McDonald basically picked out an easy target then texted his friend to come and have a go. Even without the rape conviction, that is horrendous, disgusting behaviour, and yet the girl is the one who has been treated with contempt while Evans is treated like a hero. Anyone wondering why there's a need for feminism need go no further than this case.

Yes, I think he could have been tried for conspiracy to rape wrt the crime of the rapist Ched Evans.

I think that the CPS probably had to choose between charging McDonald with rape and charging him with conspiracy to rape (which can carry the same sentence). Had the victim said she consented to sex with McDonald and then the rapist Ched Evans was summoned , then McDonald might well have been charged with conspiracy instead.

FWIW, I disagree with the jury's verdict on McDonald but I can see why it was reached.

In one mirror report on the case it Evans stated he heard that his brother was being questioned and he knew he was in trouble. The prosecution asked him if he had done something to be in trouble for, and he said no. He's so stupid that he let slip in his own evidence that he knew he had done something wrong. Why would he be concerned about his brother being questioned if he felt there wasn't any case to answer?

Ched Evan's complete lack of remorse or sympathy tells me that he is still a great danger to the public. He clearly has not been rehabilitated in any way. Although, given the way his family and friends are cheering him on, it is not really surprising.

I do believe in rehabilitation, but there are some crimes which are especially unforgivable. Someone who has committed these crimes should not have access to certain jobs or rights. Ideally, they shouldn't ever be working in a job with members of the general public.

If my dd's boyfriend had behaved in the way Evans admits to behaving, the first thing I'd do would be to get her tested for STDs, and the second thing would be to suggest very strongly to her that he was clearly a piece of scum from whom she needed to keep well away - even if I didn't think he'd committed rape. There is no way I'd encourage and facilitate the relationship the way this girl's father is doing.

And if she seriously thinks that was the first or last time Evans had played away, she's delusional.

Personally I don't think there was anywhere near enough evidence to convict him. Unless she has other medical issues, the expert testimony showed it would have been highly unusual for her to have sustained such a complete amount of memory loss considering she was 'only' 2.5 times the drink drive limit.

Also someone down thread mentioned her being 'plied with alcohol' which from what I've read wasn't the case at all - the alcohol she drank was drank before she met up with Ched Evans mate. And that it would be 'reasonable' to think that she would have been less drunk when she had sex with Evans than when she was with the other one.

But he isn't innocent. And what about his pat in the campaign that hounded her out of the country?

She may well have been too drunk to consent to either, but one had the defence of believing she consented.

You do realise she never accused him don't you? She woke up not knowing where she was and contacted the police because she thought her drink had been spiked.

HE WAS CONVICTED ON THE EVIDENCE HE GAVE IN COURT.

A jury found him guilty beyond reasonable doubt.

So no, she doesn't "deserve everything she gets" - there are laws in this country about not naming rape complainants (and these laws apply regardless of the outcome of the court case, btw). So that law was broken.
