I have kept quiet over the last few months not from any wish to be mysterious but because feck all has happened.

Well I say nothing has happened, the neighbours are now living in the bungalow and their house is occupied by a bewildering array of people. They are fairly quiet in the house but do many annoying things outside including talking on mobiles early in the morning and late at night and having sex in cars.

Anyway, got a letter from planning today telling me that planning permission for the mahoooosive fence they put up after they did all the annoying, noisy and intrusive building work, (the bastards) has been REFUSED.

Yes REFUSED! This is in no small part to the amazing letter written for me by MrsMarjoribanks. I can just picture their faces when they received it, their bemused looks as they tried to marry up the vision of ME with the letter in front of them Grin

So the fecking feckers have to take down their ugly fecking 10 foot fence.
I hope they dont, I hope they continue to think they can get away with anything they like, thus drawing more attention to themselves and getting their just desserts. SO NER!

Don't take your eye off it as they may appeal so keep the pressure on. They will if they don't dismantle it have an Enforcement Notice served with photos and everything.
This will be available to view later online (Council website)and I imagine you can get an idea of timeframes and details..good.

gallicgirl · 21/05/2012 20:55

You should ring the council tax office.

Tell them that they are living in the bungalow and the date they moved in as best you can tell. They should report it to the valuation office so they can be charged council tax as a domestic dwelling. The fact that it doesn't have legal planning permission is irrelevant as long as it's someone's domestic residence.

You also need to tell them the main house is occupied by different people at different times and as such should be classed as a house in multiple occupation. This means the landlord will be liable.

Slightly vindictive to make them pay 2 lots of council tax but that's how it goes.

So glad to see this update. Have found myself thinking about this every so often (as so often happens with random MN threads...)

cece · 21/05/2012 21:15

Good to have a victory (however small)

LoonyRationalist · 21/05/2012 21:20

Thanks for the updates, good to get some good news at long last (although v. depressing hearing about the likelihood of it being enforced)

Yes definitely report council tax evasion & the multiple occupancy thing, make life worrisome & unpleasant for them, they truly deserve it.

bobkate · 21/05/2012 22:10

Grin Grin Grin - one small step and all that. V happy for you Smile I reckon you should be doing a wee jig of victory for this one!

Kewcumber · 21/05/2012 22:16

oh hurrah!

Kewcumber · 21/05/2012 22:17

and about Ds's respite

Kewcumber · 21/05/2012 22:18

why is there a budgie on your profile...?

OhDoAdmitMrsDeVere · 21/05/2012 22:27

That is Nigel.
I found him in the lilac tree and he was poorly.
I nursed him and loved him but he died Sad
I ended up with him in my bra feeding him drops of rescue remedy until he shuffled off this mortal coil.
I had a thread and everything.
I then panic bought Carrot the budgie who has recently joined his wing'ed brother in Budgie Heaven.
I am not getting another budgie.
HTH.

thanks, all clear now (Hmm Confused)

Kewcumber · 21/05/2012 22:43

With your current run of luck are you not tempted to come out and play on Thursday?

OhDoAdmitMrsDeVere · 21/05/2012 22:48

I would love to. I think SS may have something to say about me leaving three small boys in the care of two small dogs though.
Bloody nanny state

Have a lovely time without me

well as long as they're not rottweilers i don't see the problem?

OhDoAdmitMrsDeVere · 21/05/2012 22:54

Ones only got one eye, is very old and prone to seizures.
The other is adorable but thick and thinks he is also a small boy.

I think a Rottweiler would be a better bet tbh.

Oh Mrs DV that is fabulous news. I am so glad I could be of assistance and that they realised what they were up against the planners made a sensible decision. Two reasons for refusal as well, one specifically about the impact on your property. Enforcement will be long and arduous though, as Jins has warned.

Our Council got to the point where we threatened to go in and take a structure down ourselves which got the required result, but that was a year after the refusal.

Take photos and keep a diary of the occupation of the bungalow for evidence for enforcement against that as well. The planning department know full well their intentions for that but just need to pin it on them.

OhDoAdmitMrsDeVere · 23/05/2012 08:46

I love you miss I really do.

lopsided · 23/05/2012 17:52

I love it when a thread is updated - thanks MrsDeVere.

Hope they get what's coming, I hate selfish neighbours.

MissMarjoribanks · 23/05/2012 19:58

Thanks MrsDV Blush Grin

I'm just pleased I could be of assistance.

It made me happy to be a planner again in a week of committee deadlines and general stressiness.

OhDoAdmitMrsDeVere · 23/05/2012 20:58

Pah kew you are just well jell.
