I have kept quiet over the last few months not from any wish to be mysterious but because feck all has happened.

Well I say nothing has happened, the neighbours are now living in the bungalow and their house is occupied by a bewildering array of people. They are fairly quiet in the house but do many annoying things outside including talking on mobiles early in the morning and late at night and having sex in cars.

Anyway, got a letter from planning today telling me that planning permission for the mahoooosive fence they put up after they did all the annoying, noisy and intrusive building work, (the bastards) has been REFUSED.

Yes REFUSED! This is in no small part to the amazing letter written for me by MrsMarjoribanks. I can just picture their faces when they received it, their bemused looks as they tried to marry up the vision of ME with the letter in front of them Grin

So the fecking feckers have to take down their ugly fecking 10 foot fence.
I hope they dont, I hope they continue to think they can get away with anything they like, thus drawing more attention to themselves and getting their just desserts. SO NER!

My mum's old neighbours used to talk on their phones under her bedroom window at night. Extremely annoying.

OhDoAdmitMrsDeVere · 29/05/2012 22:22

Well who knew my my borough had a Housing Standards department?
And who knew they would be so keen to pop out and investigated a dodgy HMO?

The things you find on the internet......

Loving your work Mrs D!
Maybe you should set up a camera to help with their investigations...

OhDoAdmitMrsDeVere · 29/05/2012 22:46

I think one knock on the door and the stream of various young men streaming out of the side entrance might give them a clue.
The bungalow seems to have had some decorative touches added as they have got more cocky.
Pretty hard to argue a gym is a gym when it contains sofas and beds and tvs and vases of dried flowers.

Whatever - they shouldnt be renting out the rooms in their house in such a dodgy fashion.

Excellent! Exciting developments. Do you know when they're coming?

thelittlestkiwi · 30/05/2012 02:46

Great news.

I wonder if her mortgage company/insurance company know she is renting out rooms. Buy to let mortgages are usually quite a lot more expensive (if she has one).

I wonder if there is any way to find out which company she is with short of rifling through her post.

Seabright · 30/05/2012 06:09

Yes, you can easily (& legally) find out who someone's lender is. Go to the Land Registry website and order copies of the Register Entries of the properly you are interested in.

For about £7 you get full details of owner, legal info on the title & details of lender. Costs a bit more if you want a plan too.

Can't easily do links as am on phone, but may be able to later, if needed

OhDoAdmitMrsDeVere · 30/05/2012 11:33

Just had an infuriating email.
The bungalow hasn't got a kitchen and it AND the house is occupied by the same family Hmm
They can't do anything and they are not aware of anyone who can.

Housing standards might disagree.
As for the 'one family' thing, ffs.

CadleCrap · 30/05/2012 12:00

Who was the email from? What constitutes a kitchen? I can manage quite well with a microwave and a fridge. (perhaps that's why DH does all the cooking).

I have been following your thread and my only knowledge is from the planners, but isn't the fact that some one is sleeping in there mean the building now has a different purpose?

Jins · 30/05/2012 12:01

I have an appeal decision that may help stored in my file of useful appeal decisions. Give me a minute or two

mistlethrush · 30/05/2012 12:17

Jins - I think one of yours had something to do with a microwave and fridge moved in????

Jins · 30/05/2012 12:21

I can't find it :( It definitely said that a kitchen wasn't necessary to define residential use though.

What I would say though is that permitted development rights do not allow for normal residential uses, such as separate self-contained accommodation or for the use of an outbuilding for primary living accommodation such as a bedroom, bathroom, or kitchen.

I can't remember if they had planning permission in the first place for the 'gym'. Case law seems to suggest that occupation for the intended purpose should have occurred for a period of months if not years before any change.

Send a call out for MissM as she's much more knowledgeable about residential than me.

Jins · 30/05/2012 12:21

It did mistle but I can't find it now. It would have been bloody useful. Did I post a link do you remember?

mistlethrush · 30/05/2012 12:33

I think you might have done - it was either posted in the previous thread or a pm to me Grin

Jins · 30/05/2012 12:34

I've just done a search of my posts and it hasn't come up. Will check my outbox now. It better be useful after this

mistlethrush · 30/05/2012 12:35

I can't find it. Did you send on LI?

Jins · 30/05/2012 12:42

May have done. I 'm glad you remember it though. Or maybe it was one MissM posted

mistlethrush · 30/05/2012 12:43

Oooh it could have been. I certainly read one that said something like that.

Jins · 30/05/2012 12:55

I can't find it by searching on her name either. The search engine for appeals is hideous but I'll have a go this afternoon

OhDoAdmitMrsDeVere · 30/05/2012 13:26

I may have it at home. I remember sending it to someone.

ItsAllGoingToBeFine · 30/05/2012 13:28

Jins/Mistlethrush I remember that case being discussed on one of the old threads. If you can link me to the old threads I'll go have a look (can't search on phone)

The previous one was deleted and I suspect that was the one with the links.

MrsD - did you keep a copy of the thread? Should I ask MNHQ?

ItsAllGoingToBeFine · 30/05/2012 14:05

I hate to hijack, but could the lovely planners maybe pop over to this thread if they get a chance?

Jins: I've checked the thread you linked and its not there. Must have been one of the previous ones.

OhDoAdmitMrsDeVere · 30/05/2012 16:43

'Thank you for your e-mail. The use of the outbuilding has been investigated. It does not have a kitchen and the house and outbuilding are occupied by one family. There is no breach of planning control, so we cannot take action in this respect under planning legislation and I am not aware of any other department which would be able to take action in this respect'

Appeal Ref: APP/G2245/X/09/2100324

These are the appeal decisions. I dont have a link, I have the documents saved.

Does anyone know how I reference them please?

I am pretty Hmm at the email to be honest.

The building was approved under permitted development as a gym.
It is supposed to be ancillary to the enjoyment of the main house (is that right?)
It is clearly NOT a gym.
The house is clearly a HMO and not a family home anymore.

HOW can it be ok?
