To give you an update on the Backyard Bungalow saga?

I have kept quiet over the last few months not from any wish to be mysterious but because feck all has happened.

Well I say nothing has happened, the neighbours are now living in the bungalow and their house is occupied by a bewildering array of people. They are fairly quiet in the house but do many annoying things outside including talking on mobiles early in the morning and late at night and having sex in cars.

Anyway, got a letter from planning today telling me that planning permission for the mahoooosive fence they put up after they did all the annoying, noisy and intrusive building work, (the bastards) has been REFUSED.

Yes REFUSED! This is in no small part to the amazing letter written for me by MrsMarjoribanks. I can just picture their faces when they received it, their bemused looks as they tried to marry up the vision of ME with the letter in front of them Grin

So the fecking feckers have to take down their ugly fecking 10 foot fence.
I hope they dont, I hope they continue to think they can get away with anything they like, thus drawing more attention to themselves and getting their just desserts. SO NER!

I knew this was your thread! And being the saddo that I am was wondering how things were.

Glad they have been refused PP for the hideous fence... lets hope someone sorts out their breach of planning for living in the 'gym'

Brilliant. Well done MrsDeV! So glad they at least have to take down the Berlin Wall fence.

Still shocked that they were allowed to get away with effectively building a second house in their garden without permission, though!

I thought the builder owned the bungalow. I couldnt work out how the neighbours got the money to build a new house in the garden.
Now, because they have failed to submit new plans for the fence, I am thinking he has just taken the money and ran.

He knew damn well the fence was too high and too ugly, he also knew damn well that living in the bungalow was not allowed.

But he gets paid whatever happens.

Wanker.

OR they have all got away with so much for so long they just think this is a slight annoyance and will be ignoring it.

Mrs DV, this has probably been done to death on one of your previous threads, but how have they actually got away with this? What have the planning dept said when you've told them people are living in it? Do they not believe you, or is this so commonplace that they don't really care anymore? I case it takes the pressure off the local councils to provide social housing...

It was built as a gym MrsV. There was even some token gym equipment moved in.

It's just recently that they've moved in I guess. I have to say that while they've got a current planning application running it wasn't the best time.

On the last page of the letter it said they would be seeking enforcement (or summink). That sounds exciting.

jins I am thinking more and more that they have been spun a load of crap by the very experienced builder. I am not saying its not their fault (it is, they are knobs) but I get the feeling he just kept telling them not to worry and to ignore us and anyone who came round.

Oh enforcement is thrilling MrsD. Keep up to date with your pelvic floor exercises in case you wet yourself with excitement.

A burly enforcement officer will visit. A series of letters will follow. An appeal may happen. The fence will remain in place. It may go but it may take a while. When they put planning legislation together they didn't give enforcement officers the sort of powers that the public would like them to have :(

yeah!! Grin Glad you're finally getting somewhere with this MrsDV - I've been on each of your threads and often wonder how things are going for you. No-one deserves to have to put up with the kind of crap that they've put you through, least of all you!

If you need a mob few people to help take photos of the nawty people shagging in cars use of the gym as a house, I'm sure there's a few MNers that would gladly oblige! Grin

will planning do an unannounced visit? it wld be a pity not to catch them in the act of having an actual dwelling at the bottom of the garden.

Yes enforcement visits are usually unannounced. I had a warrant card and everything when I did it for a week

Better story about Harry Collinson here It was terribly sad, especially as it was filmed :(

That is terrible Sad. I was going to ask what would happen if MrsDV went at the fence with an axe (surely it can't be criminal damage at this stage?) but that makes you realise how high the stakes can be in planning disputes, definitely not worth getting killed over. Sad

Still cheering for the first small victory though and hope there is more to come.

I wonder if there is any way you could contact the enforcement team, let them know they can pull down have a look at the fence from your garden, maybe even have a nice cup of tea upstairs in your bedroom, and admire the view.

It would be criminal damage. Only after going through all the various stages of enforcement (and there are many) would a council even think about carrying out the demolition themselves

(and I doubt that they would for a fence :()
