To think this woman is putting her child in a very dangerous position with her racist rantings on public transport?

Whilst I think this woman's behaviour is beyond disgraceful and I am relieved she has been arrested so that the little boy will be away for her for at least a brief time I was also upset to hear the black lady's generalisation of British/English people not wanting to work. You cannot fight racism with racism.

Oh my lord Shock What a horrible woman , She must of been drunk who in there right mind would behave like that and especially when she has her own child with her, I would of had to get off the tram before i said or even did something , I cant stand people swearing or being crude in public when they can see my child is there ! so glad she has been arrested, now she will have to answer to others and not just to a captive audience of commuters, she will have to explain herself in an interview and hopefully, before a court. Racially aggravating factors actually stiffen a sentence, its classed as a hate crime. im glad they have found her and im glad someone videoed it.

That is really upsetting, especially the effect her words have on the young man behind her. He did very well to restrain himself against her vile ranting.

She can be charged with racially aggravated abuse (can't remember if it's S5 or S4).

However there does appear to be some issues with the way she holds herself/mouth movements. It could be indicative of mental illness or drugs. Either way this is horrible footage, having not really witnessed racial abuse like that before it is really quite shocking. I think the women who stood up to her were trying to challenge her bigoted views, not fight racism with racism.

well....thats the question.

she has commited a racially aggravated public order offence - thats clear.

the police are only there to gather evidence - theoretically if its racially aggravated it should go to Crown Court!

but like i say - the police gather the evidence - thats the end of our role.

the evidence is pretty damning though - she is caught on video committing the offence.

i would hope she will be charged and put before the court. I have dug my notes on racially aggravated offences out....but i have learned that theory and actuality are often two different things in this game....

The little boy's face is pixellated in the media reports but clearly visible in the You Tube clip. Makes me really uncomfortable.

section 5 - as far as i remember it goes something like this....
used threatening abusive or insulting language or behaviour displayed in writing sign or visible representation within hearing or sight of a person likely to be caused harassment, alarm or distress with the intention that their action would have that effect....

a section 4a would be intentional - you could argue a 4a in this case but im betting the charge will be a 5.

Ah, so she is from New Addington. Frankly, there are areas of London where this shit happens all the time, and New Addington is one of them.

I agree that there are problem MH or substance misuse issues going on here, though. That poor kid. And they were both lucky that she didn't get slapped.

My mum once intervened, at midnight in Brixton tube station, to try to shut up an out-of-her-head young girl who was screaming racist abuse. Sadly, passers-by assumed DM was part of the problem, and soaked her in beer.

Can I just ask though if anyone one knows the answer to this:

I thought there was a law that recorded evidence was invalid unless you had consent from anyone in the recording that you were recording them as it is a breach of privacy?

Does anyone know? Im just wondering if that law does exsist if it would effect this case?

I don't think that can be true, Roseflower, or CCTV/footage filmed from police helicopters wouldn't be legit. Also, do you remember the filmed footage of Stephen Lawrence's alleged murderers, from a camera planted in their flat?
