I want to move away with my daughter and my new partner - my ex is saying he's going to talk to his lawyer and see about custody and I'm worried he's going to try and stop us or take us away. We haven't sorted PR yet as not been split up that long: if he gets it, can he stop us moving?

if you dont agree to pr a judge will ask why? then,in light of his shared residency already in place,will grant it anyway.....so a moot point about PR really

Doesn't matter a watery shit what your relationship with your ex was like- it's about his relationship with his dd. He sounds like he has been a very hands-on dad, regardless of your past together. Your dd may well resent you for this in years to come if you do move, and her relationship with her dad falters (which, with the best will in the world, it will, given such a distance)

Why should your ex move too- presumably he has a job/ family/ friends where he is! Why should he be completely uprooted because that's what suits you? If this isn't a wind-up, I am Shock and Sad that you would disregard him so easily.

i would suggest you stop thinkking of yourself and your new boyfriend and have a very, very long hard think about your daughter.

this is so unfair on her for so many reasons....

i am quite shocked that you'd even be considering it tbh, and i hope to god that the courts don't let you do it

He will get PR anyway. Are you sure he doesn't have it now? Depending on DD's age and if his name on birth certificate may have been automatic.

"if he's that bothered" he could request that the current shared parenting arrangement continue. You seem to think his objection is because you want to move for your new partner's sake. Perhaps his objection is because he wants to continue to be a part of his daughter's life in the way he is now. You know, like you do.

No, it is a new job which is more secure, and for a variety of reasons I think it is the right thing and the right time for a change of scene, and not to be hanging about in the same environment as things were before, when they are so different now. I think that a move would be a fresh start and we could make it work, even though in lots of ways I would also be sorry to lose what I have here.

All I wondered was whether in theory I'd be able to do it.

you would need to answer the questions i asked,as well as having done thorough research.....the judge will ask searching questions......yet you dont even know who will cover the travel??
