Disgusting neighbour's habit

I live in a 3rd floor flat, only one level above me. Our flats are arranged so that the balcony gutter empties onto my balcony, right by my balcony door.
I'm a council tenant, and Upstairs is leasehold, rented out privately.
For some weeks in the height of summer there was this absolute rancid smell coming in from outside, a mixture of rubbish, rotting waste and piss. It was clearly coming from my balcony, but for the life of me I could not work it out, until I slipped on some greasy residue on my paving, and I realised it had come down the gutter. I placed a takeaway container underneath and sure enough within a few days, the container was full of cooking fat and peanuts! Bizarre.
It took me an age to wash my patio and get rid of the smell, not helped by all the maggots that had hatched in the fat and mouse droppings!
Grim.
I asked them to stop tipping their fat down the gutter, and they apologised.

Shortly after, I smelt a very strong smell of urine. I thought it was dog going outside and was seriously considering taking him to the vet, thinking he had a kidney problem or diabetes.
Only I twigged it didn't smell like dog pee but human, incredibly pungent.
So I got another take away contained, and sure enough the next day it was filled to the brim with piss.
The bastard is pissing down his balcony drain knowing it empties onto mine. I've emailed my landlord, and their leaseholder, who gave me a standard response, and left notes in the lift and entrance door (not naming and shaming, just polite notice, don't piss on your balcony), and he has not stopped.
I've just watched as piss came down my gutter and emptied onto my balcony for the 3rd time this week.

What other action can I take? Any advice?

I'm tempted to start leaving the containers of piss on his doormat.

I work for a council and my advice would be to ring your landlord the council tomorrow and ask to log a formal complaint. Then log a complaint that your initial report has been ignored and nothing has been done.
Contact your local councillor/MP and ask them to contact the council your behalf too.

As rubbish as it is most places will only start to jump through hoops once a complaint has been logged or they get a councillor enquiry.

I would be tempted to put a plastic bucket under it to catch it all and empty it on to his balcony every evening. Problem is that he is probably so grim that it wouldn't bother him.

Complain to Environmental Health and advise them that you consider it to be a Statutory Nuisance under Section 79e of the Environmental Protection Act 1990 (any accumulation or deposit). Advise them that you consider that an Abatement Notice would be an appropriate form of response. Ask them also to serve an abatement notice on the landlord as they are aware but have not taken any action to resolve.

Failing that, go to the antisocial behaviour team, and advise them of the issue and ask them to serve a community protection warning on the occupant upstairs, followed by a community community protection notice. This is under the anti social behaviour crime and policing act 2014.

clearly, there’s some very good advice here from much more knowledgeable people than me. Can you connect a pipe to it so at least it doesn’t land on your balcony?

I’d be tempted to affix another bit of guttering to channel it directly down the drain. I’d definitely leave containers of pee on the doorstep. Lids off with concerned notes sbout the noxious liquid seeping from the gutter. Perhaps he could contact his landlord?

I'd log it urgently with Environmental Health, and I'd ask them whilst you await it being investigated, if you could get a plumber/handyman to come and cap it off.

If it's capped off, eventually his stinkin pish will back up and eventually be level with his own balcony.

The guy is a disgusting pig, and I'd be making damned sure EH get this dealt with and stopped as a matter of urgency.

I've never lived in a flat. Is it normal to have gutters empty on to your balcony? That seems like a really stupid design to me. Even if it was just rain water coming through it would be stupid.
Make a complaint to Environmental Health as well as the council. I'd be tempted to report it to the police too and keep logging any other incident with them to build a case for harassment. Contact your MP, they can be helpful in situations like this.

I would make a police complaint, with all the pictures and include evidence of all the times you've told him to stop. If you've told him several times to stop and he hasn't, they might investigate him for harassment. If you've only contacted the landlord informally write a formal letter to the landlord to complain, attaching evidence. It's also worth contacting the Citizens Advice Bureau and explaining you've had no reply from the council etc - they might be able to advise on next steps and also what remedy you can expect from the landlord, and what you can do if they don't take action. Good luck - this is truly disgusting.

WTF is wrong with him?! Disgusting bastard! Make formal complaint and attach the photographs and keep complaining until something is done about it. I couldn’t live there with him as a neighbour. What else is he capable of, how low will he stoop?! Sorry you’re having to put up with his nastiness.

Difficult one that. With comments suggesting pour it through his letter box etc I would be very wary about provoking someone who is doing stuff like that, what would they do next?

like others have said I would go down the police route and of course complain to the landlord/council. Move out if possible! Although I know it's not always that easy.

Write an aggressive letter to the leaseholder and tell them you will contact environmental health if they don’t do something about it

Maybe buy a piece of guttering to extend it over and away from your balcony.

It’s very grim though, your neighbour should be ashamed.

Exactly what I was going to say @OverlyFragrant - extend the pipe so it doesn’t go on your balcony (ideally it would go to another pipe and away entirely while you get it dealt with properly). It’s disgusting though!

I would be raging and tempted to return the piss through his letterbox. However, stay on the right side of the law and complain based on advice above.

i would fill a card with glitter and mail it to him. He sprinkles his tinkle on you, only fair to get him back.

If you have a communal entrance put all the evidence there, lined up with the lids off and a note explaining which filthy bastard is doing it - in several languages and to stop!
