Southport - reporting restrictions

So the attacker in Southport was a child (17) so will be not be reported on due to reporting restrictions. Due to proximity of the alleged attacked to adulthood and the severity of the crimes do you think in this case it is in the public interest to release at least some details of the alleged killer? Not releasing details fuels speculation that at a public level may not be helpful in my.opinion.

In addition I would think there may be a high chance the attacker had a severe mental illness so after the Nottingham attacks will the debate about personal responsibility for actions during psychosis be raised again?

No. It's an active criminal investigation. Even if the perpetrator had MHN, and that's pure speculation at this stage right now he's still in police detention. IF and when they proceed to charge he'll be remanded and at that stage the Crown Court can remand to hospital rather prison under the MHA for assessment pending the trial. Given his age he's more likely to be remanded to youth detnetion and assessments carried out there.

There is literally nothing to go on right now.

But even if he has MHN he'll still be charged and convicted in the same way. The only difference may be that the CPS agrees a charge of manslaughter with diminished responsibility on the homicide charges IF that's more likely than murder. Even then he will still be tried and found guilty of the offence, he's just likely to be sentenced to a hospital order.

The Calocane case was tragic, but a major reason the 5 psychiatrists who assessed him and agreed he had active psychosis at the time of his crimes also recommended that a hospital order with restrictions under the MHA was better than transferring him to prison under a hybrid sentence is that under his current order if he is ever discharged from hospital he'll be conditionally discharged and supervised by MH in the community for the rest of his life, and can be recalled to hospital immediately if he stops engaging with treatment. Whereas if he moves to prison he will be able to apply for parole and subject to a probation order if released. Adding a punitive element to his sentence will do nothing to improve public safety. And statistically he is likely to spend much longer in hospital than in prison.

The worse thing about all this speculation and naming him on social media is that it stops him having a fair trial, which in turn stops the families getting justice for their little girls. But the thickos don’t think about any of that while they’re lobbing rocks at the police and setting fire to cars, bins and fences.

It’s already been said but if this person turns 18 before they stand trial, the reporting restrictions will expire and the press will be free to report their identity.
If they are still 17 the media can apply for the restrictions to be lifted. In a case like this, I’d say there is an extremely high chance the application would be successful following conviction (I have a lot of experience in this field).

I can’t ever remember reading about a person with serious MH issues targeting little girls in a dance class. He wasn’t randomly walking down the street, attacking those he came across. He planned this. It was in a secluded place, down a cul de sac. Also, if he had MH issues, wouldn’t they have already said he’d been detained under the MH act.

I think it’s more likely he’s a disaffected young man, who has been radicalised.

I think we, the public, do need to know WHY he did this. We can’t just sit back and let this become just another thing that we reflect on during its anniversary.

Enough is enough.

Presumably motivations may be something that is an important part of any upcoming court case, so it would be deeply inappropriate to jeopardise a fair trial because some thugs think they need to know.

And the very last thing the grieving families and the local population needs at the moment is a bunch of violent vigilantes setting fire to the place and attacking the very emergency services who had to deal with the tragedy.

They have released far more details than I'd have expected making it very easy to identify the person.

I am appalled at the actions of the rioters last night, most of whom seemed to have cone from outside the area.

There will be CCTV footage from the train station hopefully.

What we actually need to know- explicitly- is how we are being manipulated by bad actors.

A name, faith, and reference to mental health and immigration status was repeatedly shared yesterday. Repeatedly.

Anyone who bought into that needs to have a serious think, and we all need to understand how bad actors are using social media to manipulate us.

It’s the most important part of this, imo, given that we can’t help the victims.
We need to be better about stopping the riots and backlash by stopping misinformation.

That was my thought but it's pure speculation at the moment.

Targetting women and girls should be considered as terrorism, imo, but at the moment it's not. So, if this is the reason, then the police can only report that they've ruled out terrorism. They work with the law as it is.

You'd have to have MH issues to do this in the first place

The Dunblane man had MH which is why they completely changed the gun laws at the time

Thank goodness we did that immediately and didn't end up like the US completely out of control

It serves no purpose. It's not in the public interest either way, as there's nothing the public can legitimately do with that information.

If they say he's a muslim immigrant people will go and burn down mosques, if they say he isn't people will cause trouble anyway like yesterday and say it's a cover-up or lies.

Calocane is not likely to spend longer in hospital than prison ! That's the whole point of why people were so angry about him being detained under the MH act. He's has schizophrenia which is highly treatable today. You can't keep someone detained under the MH act who's illness has been treated and is stable. He had a violet past and was stockpiling weapons I believe, showing a degree of planning. I know people who work in this field, and have done for years, who are absolutely convinced it's completely the wrong call and he should absolutely be under a hybrid order. Most members of the public I think would be completely shocked at what actually goes on. Unfortunately I can see this case going the same way..only the public might not even know because of reporting restrictions!

How many of the young men last night were radicalised to break the windows of a mosque and injure 50 police officers? There are more far right young people referred to Prevent than there are Muslim young people.

Schizophrenia is easily maintained

By now we have care in the community it's up to them to take their medication

Lots don't because they have MH issues

So if they won't take their meds and there's nowhere for them to go and be made to take them for the publics safety

What can you do
