I do not understand the grumps on this thread. I’m still team plausible because - amusing writing aside - it is reasonable. ‘We bought a house that during conveyancing was revealed to include a separate garden space (which there are lots in my home town up North), on visiting the space someone has been using it and is cross we don’t want to let her stay, what shall we do?’ So far so boring. Equally I don’t get the support of the squatter - she knew she was squatting, must have known the property was being sold and now the jig is up - too bad but she’s had a good run. Would everyone be so tolerant if it was a parking space she’d been using?

It's fairly interesting land law type question. Not sure many people make up land law or conveyancing questions!

And you can't claim adverse possession when you have been given explicit permission to use the land. Also now much harder for registered land as the owner can just object to the possessors claim (even if they passed the adverse possession requirements) and take actions to remove that person within 2 years (I think)

@YaMuvva I counter your Claire Foy with Michelle Docherty. You could have this set in the early 1910/20's. Think of the finery you could wear doing your notlottment. Plus she's been partial to getting herself a bit dirty so wouldn't mind (I'm sure..??)

Of course they wouldn't. Parking spaces are at the very top of MN's "it's mine, get the hell off" hierarchy of valuables. Land people actually own, it would appear, not so much.

Borne out by the fact that on thread 2 someone accused OP of being a ‘colonial style bully’ because she wanted her land back !!

Perhaps try reading the original thread first? Where the OP said that she became aware of this plot of land during the conveyance process and was informed by the solicitor.

And, as it was subsequently found, the seller had failed to declare this information (about Babs and the garage squatter).

He did. It’s on the first thread. Found out during the conveyancing and informed OP. The seller had failed to disclose that, and the garage being used by someone else.

EKL could be an extra, one of the other allotment holders, along with a few other characters like flat-capped man and his dog (David Jason, with at least 2 of Monty Don's dogs ), worthy young earth mother (Hellin from the Archers) and so on.

EKL still doesn't speak much English, but every now and then she's been known to give Babs a few of her extra parsnip, beet and chard seedlings from her veg stash.

I love a land law dispute!

and adverse possession is just that - adverse, clue’s in the name!! If you’ve given someone permission it’s not really adverse 🤷🏼‍♀️ unsure why so many people keep mentioning it !

Just one thing occurred to me that you might not have thought about, and that's something I believe is known as "adverse possession"?

HTH - and looking forward to updates and an invitation to the ribbon cutting ceremony once you obtain possession of your own property.

But yeah - look into that adverse possession thing. Sounds like that might be a go-er.

Are you kidding - I do hope so !! Adverse possession has been done to death. Not applicable here - if you’ve read both previous threads you’ll know why.

I do find these threads fascinating. I'm still very confused about the way property sales are handled in England. I'm American and pretty old and have bought and sold quite a few houses in the US because of job moves. In every one, we toured the property either the day before or the morning of the closing, and everything was vacant at the time. If there had been boxes in the garage, those would have to be moved out before money was disbursed. It was the same when we sold. We moved everything out before the sale closed.

I've read other threads about people showing up to their newly purchased house and find that the sellers are still there. Or they are several months along in the process of buying and selling, and someone just walks away, or most confounding of all, a seller asks for more money just as everything seems to be ready to close (or whatever it's called in England).

Yes. The clue is in the "adverse" part. It's not adverse, as I understand it, if occupancy is by permission.
