My dh hasn’t paid the rent ffs

Soo I’ve just had a call from our letting agent went to voicemail as I was on a call and my fucking husband hasn’t paid the rent for the last 2 months….

The bastard is at work and his phone has been switched off

I don’t have the money to pay it all - I did wonder why he had some extra money

We have separate accounts he pays rent etc I pay other bills it all works out fair

I am so bloody angry I daren’t phone the letting agent back and I’m off to check his emails 😡😡😡

It sounds like it might be a honest mistake, if emails are in junk folder and he had a pay rise then he may have thought the extra money is the pay rise too.

hopefully he’ll have the money to pay it today or at least have the £100 to put towards your money then once it’s paid sit down and work out your finances.

we have one bank account for bills and a shared account for us and it works out ok as we know all bills are paid.

Ring and email the agent, explain it comes from your husbands account and you are unable to get in contact with him atm as he's in work meetings with his phone off. Tell them you will be back in contact once you've checked his bank and spoke to him.

I hope you get hold of him soon

Wait to see what he says. If it’s a genuine mistake then he’ll have the money to pay it.

Ring the letting agent back. Explain you didn't know and ask if the landlord will proceed with eviction processes if you pay the amount you have.

I wouldn't be paying everything you have in your accounts without knowing this. You might need you the money you can get to look for a new place. Is the tenancy solely in your husband's name?

OP, I don't know how quick to act your LL agency is but I wouldn't send them any money till you've spoken to DH and hopefully found out what is going on or if this could be an awful mistake. I might email them and apologise and ask them to please give us 48 hours to sort this out and get back to them. Hopefully that will stall any action while they give you a chance.

Try not to panic. In reality being 2 months in arrears could mean one month of actual arrears and the current month’s rent is just a few days late.
The mention of the Section 8 is likely to be just a standard paragraph.
The most important thing is to contact the Letting Agent to let them know you are treating this as a serious matter that you want to resolve.
Many Letting Agents and Landlords get worried when the rent is not paid with no contact from the tenant, but are very willing to work with the tenant once contact has been made.

The tenancy is in joint names. However the letting agent always deals with my husband (no idea why)

Ive found 4 unread emails in his junk folder and one in my junk folder.

We are over the 8 weeks so a section 8 can be applied for.

I have emailed the letting agent asking for them to call me - and said that I have enough to pay £1400, and will this stop and proceeding if I pay it today.

I’ve called my husbands work and spoke to the receptionist he’s still showing as in that meeting.

Don't send anything yet! It won't make a difference whether you send it now or send after lunch.
Take a deep breath. Chances are it is a mistake as he would notice 1500 extra on his account surely.

I wouldn’t panic about the section 8, it would cost your landlord a lot of money and stress as if you didn’t move within the allotted time it would go to court.
I also work in housing and we would give a section 21 for eviction, an 8 would be for serious damage to the property or any other serious issue.
id speak to your husband before sending payment to the agent x

I'm a LL OP. That is correct OP. A section 8 can be applied for in a court of tent is 2 months in arrears. I'd advise emailing EA and saying emails had gone to junk mail. I'd be paying something across immediately even £200 because then you are technically less than 2 months in arrears and LL can't apply for a Section 8. Speak to DH asap to find what he is playing at.

I don't think stbxh would, he just seems to look at the statements which he gets every 3 months. Whereas i check it at least a couple timea a week.

There's a lesson here to check your junk folders regularly. I check mine every few days.

Into it monthly to cover it then this won't happen again.

Sometimes these things do happen but I find it odd that the rent isn't on a direct debit or standing order especially for that amount.

If the direct debit bounced and they try again and it bounces again normally they then cancel it but surely he would have heard from the bank and the agents the first time?

A Section 8 is for rent in arrears of 2 months or less. LL will apply for costs to be added to judgement. Section 21 is no fault eviction and takes far longer to get to court than a Section 8.

Not if you didn't look you wouldn't. Not everyone keeps a close eye on their account.

Plus he's had a couple of periods in hospital so might be behind with admin.

If they apply for a section 8 I don’t think there is much I can do about it apart from cry

Rent is due on the 2nd of every month so we are 8 days over even if I pay £1400 we are still in arrears

This is so fucking stressful

Well, again, a) he has been in hospital and b) for example, I have a new phone. The notifications are all screwy and it keeps updating and changing them again.

This thread reminds me of the speed awareness course I went on - the instructors said that NOBODY is immune to making these errors, we all have failures in processing. And usually we get away with it, therefore assume that it was because we did everything right.

Calm down - take a deep breathe - stop panicking and wait for your OH to come out of his meeting so that you can discuss it with him
