Jeremy Vine is threatening to sue

Just read on Twitter that Jeremy Vine has screenshotted a tweet accusing him of 'underage sex' and is threatening to sue the poster.

I know MN keeps taking these threads down, quite sensibly, but do be careful of naming anyone on SM in relation to these allegations, it wasn't even a tweeter with a particularly large following. I don't want to link to it.

He would need to be stupendously thick to start legal preceding for liable if it was him. He is very far from thick.

That's how it can't be him.

You can't sue for liable it's the truth. Therefore it's not him.

Also he's come out and stated he's doing his show as normal on Monday. I suppose he could be making that up.too, but it will soon be obvious if he is.

I'm glad he's spoken out and threatened legal action. I'm fed up with stupid people hiding behind the presumed anonymity of the Internet and using it to smear people based on no solid proof for their own amusement. I hope he sues the twitter twat, and Katie Hopkins. I hope he gets a huge payout. Maybe that will act as a deterrent the next time someone thinks about posting baseless accusations online thinking they're harming no one.

I've seen someone on reddit this afternoon floating a suggestion made on mumsnet as "proof" of who it is. It was just speculation on mumsnet but then gets repeated as fact elsewhere. Absolutely ridiculous.

There's a lot of people who are ignorant to law and socail media. Mil has reposted identity leaks of people out of prison. When you point out it's illegal to these people it ups their indignation. They don't belive there is law around these things and don't realise the written words sticks and can bite you back.

I have been known to have a rant or two on twitter but I could almost certainly suffix everyone with "if you don't like it sue me". All about my county SEN team.

Yes, that's the one.

I am not a lawyer, but as far as I understand the law in England in defamation it goes something like this.

You can say what you like about another person, but if it's defamatory, i.e. would damage their reputation/public standing, they can sue you for damages. However, if you can prove that what you said was true, that's the end of their case. If they can prove it's false, or the jury/judge believe it's false, you will have to pay damages, which would be higher if the defamation is libel rather than slander. Libel is written or otherwise permanent, slander is spoken and would only survive if someone who heard it repeated it. Defamation on the internet would be libel, I'd have thought, given that it's just about impossible to be sure that something published online has been entirely deleted.

Feel free to correct this if I've got it wrong, which is not unlikely!

She has a history of being sued, doesnt she? Or some sort of actions against her anyway

She made a very careless defamatory allegation against Jack Monroe. Monroe sued and won. Hopkins lost her home as a result. I wonder if this has left her with so little in the way of assets that she doesn't care about being sued. She would be unable to pay any damages or costs.

You are spot on:

Libel is a defamatory written statement and slander is a verbal statement.

Firstly it must be made in a public manner ie not in private or just to that person. Secondly it must be knowingly false or with a disregard to the truth, meaning the person didn't try and establish if it was true or not.

Thirdly the statement must be defamatory and the definition of this is fairly broad such as someone has committed a certain crime, or is incompetent at their job.

On these tests Jeremy Vine would certainly win a libel case.

The Sun have sunk to a new low in trying to sell papers/get clicks.

They were protecting Schofield a few weeks ago and now they’re dropping hints about there being another Savile at the BBC.

I reckon it will turn out to be someone called Colin who reads the news every third Tuesday in the month on BBC Radio Back of Beyond.

Any employer should conduct an investigation for allegations of this nature.

And the investigation can really only look at the employee and ask 'did you do this'

And the BBC are claiming (if true) that they have not received further information from the family.

The family should have reported this to the police in the firsts place.

Had a look at Twitter there and it's just turned into some giant game of Guess Who. Basically the name of any man who commands a six-figure salary at the BBC is being thrown about there.

Goldfoot The Sun did a deal with Schofield, they published a sympathetic interview with him. If he didn’t agree they would have thrown him to the wolves, much like this latest “celebrity”.

This allegation does need to be investigated, but it’s not fair to throw names out there, forcing people to defend themselves.
