@TomPinch no, that's not the only reason for arrest. Fingerprints, DNA, the need to carry out searches (an arrest gives powers of search without a warrant), keeping someone or evidence safe.... Lots of reasons.

And Boris Johnson has not been arrested whilst an MP or PM. He was interviewed for his Covid breaches by letter as we're all the others for that one.

I'm no fan of either BJ or NS, but let's get the facts right.

Have you read the article in the OP? For starters.

I don't click on daily mail links, and honestly I'm sure as it's been widely covered there's lots of other places to link to, but obviously not a concern for the op. But I'm aware of the allegations. However given there's lots worse happening with other politicians the dislike seemed strong. Not saying its a race to the bottom and just because somone does worse we should excuse wrogdoing. I realise though it's the anti trans stuff so I'll dip out. Obviously it spills over into other topics at times. But it's not a place for me and I have no interest in adding fule to the fire.

Thanks - I wonder how that would apply to Sturgeon though.

(NB - I wasn't commenting on whether or not Johnson been arrested, only that the oaf would wrongly consider that he'd been subject to a witch hunt.)

As an SNP member, I'm just here to count the galloping fannies (particularly those who fail to understand the Scottish legal system) and to remind posters of these three words: CONTEMPT OF COURT.

Fire in 👍

Love it. The Sturgeon-esque iron fist. Trying to shut down debate as ever.

TheHandmaiden · 11/06/2023 23:08

@PinkFootstool - isn't it more that an arrest can be done to secure compliance? For example, the police cannot just ask for my fingerprints and get them. I can say no or yes.

But if they arrest me then they have a legal power to take them.

So when someone is arrested, it can be taken secure an outcome so the police have the correct legal power to move or gather evidence.

However, the use of the power is to give the arrested individual no choice. Otherwise a person is at liberty to speak or not speak to the police generally:

@Keitharingsbitch no not “anti trans”, pro women’s rights. There’s a very big difference.

Can an English person in England be charged with contenpt of a Scottish Court?

@Keitharingsbitch my 2nd post about a minute after the first was a non DM link. Guess you didn’t look at the thread very hard?

Could we have some evidence of that because I am
not a fan of Johnson but I don 't think he has ever been arrested?

I'm sure I read it earlier on in this thread. The OP said 14 times he was arrested. An over exaggeration I think

Technically it's possible - Scottish courts have jurisdiction over matters that substantially concern Scotland wherever they occur. If someone elsewhere in the UK actually did publish something likely to unlawfully interfere with the proceedings, there's a process to request "requisition" and/or "transferrence" of the accused via local authorities in their UK place of residence (if they refuse to appear voluntarily in a Scottish court). This is similar to extradition, but among the various jusrisdictions of the UK rather than internationally.

I think the person who speculated upthread that the site owner is culpable are likely wrong, though - previously social media sites which allow free and even moderated comment have not been pursued and the liability has fallen to the content creator/poster. For example, the Scottish authorities had no recourse even to compel Twitter to delete the tweet by Clive Thompson which named (accurately or not) two of the anonymous accusers in the A Salmond case - even though Thompson himself, a Scottish resident, got six months' prison time.

The only galloping fanny is you hun, especially if you can’t see what an absolute raging throbber she is

Sothisisitthen · 12/06/2023 01:35

Hmmm guess she might find out why single sex prisons are important.

QuintanaRoo · 12/06/2023 06:46

@AspiringChatBot thank you, that’s interesting. Especially about the individual getting prison time and Twitter getting no action. Years ago MN was taken to court for libel over the comments of one individual and it was definitely MN not the person……so no idea how it’s decided.

Aren’t they the things she stanned for, @Deathbyfluffy?

Bookist · 12/06/2023 09:24

Contempt of court? What about Sturgeon's contempt toward the whole of Scotland, with her involvement in the current situation?
