76mph in a 50 zone - what to expect

My hands are in the air, was driving somewhere new for the first time today (only me in the car) and was on a 70mph dual carriage way, then I see police on bridge above with speed camera looked at speed and see on the sat nav to my horror the road had changed to 50, before I knew it back up to 70.

Iv definitely been busted in that bit of road. And feel a complete idiot!!

Anyone have any recent experience?

I know that I was speeding so if you are just popping on the tell me I could have killed someone etc please don’t, I am looking for genuine people who have experience of this.

Wanted to add as I’ve seen on old forums/ posts on line, that I’m a single mum and key worker so I absolutely cannot afford to lose my license! - again popping on to tell me I should will not be helpful thank you in advance.

Last year my dad received a penalty as he was doing 70-something on a motorway, but it was a smart motorway and the limit was 50mph at the time. He got three points and the standard fixed penalty fine. Had to send his licence off to be endorsed, and tell his insurance company who bumped up his premium for the next year. So all in it was probably about £300-£400?

I've clarified that those big electronic signs on smart motorways with speed limits in a red circle aren't a suggestion!

You could face disqualification being that much over, you are just on the threshold of 76

Whichnumbers · 17/05/2023 16:47

Im not sure but as far as im aware exceptional hardship is being reeled back in, as its not working (drivers continue to break laws even when they have the choice not to after exceptional hardship has been pleaded on a previous case)

if you've got a clean licence e and hour first speeding offence though, surely it'll be a fine and 3 or 6 points

gamerchick · 17/05/2023 16:49

Even if it was 70 you were still speeding though. Nothing to do with changing to 50.

Whichnumbers · 17/05/2023 16:50

sorry, just checked and it looks like it would be court, 4-6 points and possible 7-56 days ban. If you get a ban, you'll not get points

the fine can be 150% of your weekly income

What? The speed limit is 70 on dual carriageways with a central reservation

That's not true. The 10% plus 2 guidelines mean you don't normally get a penalty unless you're going 79mph. 76mph in a 70 zone is generally ok and doesn't equal a ticket.

Myn · 17/05/2023 16:53

@Whichnumbers it definitely is in my force, it's now referred to court if you wish to contest your fine and have the court hear the circumstances.

Therein lies the problem
Everyone thinks this is some kind of rule. It isn't.
Generally they DO use this but councils reserve the right to change the acceptance to what they like. 10%+2 is not enforcable by law. You can still get done for it.

Vegasfox · 17/05/2023 16:59

Thanks guys. I’m totally gutted.

yup clean licence - did a speed awareness course about 8 years ago for doing 54 in a 50 but that’s it’s since.

Of course it's true. If you are going at more than 70mph you ARE speeding. The ticket issue is separate. It was speeding regardless of the limit.

OP said she was doing 76 in a 50, even 76 in a 70 would get a ticket.

Isn’t that folk lore that used to be spouted when speedos weren’t accurate?

OP was doing 76mph, so speeding.

Is disqualified and banned the same thing?

As I would I have to take my test again? 😳

Would you mind clarifying to the rest of the country as well?! I feel like I'm the only one who doesn't just ignore them!

hilbil21 · 17/05/2023 17:04

Someone I know did 69 in a 50 (thought it was a 70 like you) and got a £900 fine. It was based on something to do with his wages I'm sure?

DRS1970 · 17/05/2023 17:06

26mph over the speed limit is a serious offence and will probably go to court. You could get disqualified and fined up to £1000 as well as points in your license.

kokeshidolls · 17/05/2023 17:08

My DH did 71 in a 50 (not on a motorway) and got 3 points and £100 fine.

I didn't say it was a rule, I said it was guidance. There's a difference. The guidance is used by councils differently therefore it is incorrect to tell someone they're speeding if they're over 70. It's not as simple as that.

Dodgeitornot · 17/05/2023 17:17

HannahHasThePower · 17/05/2023 17:00

No, it's guidance. It's not law. This can be used by each council as they wish. But effectiveness of cameras is generally within 3mph.

plasticpens · 17/05/2023 17:18

Of course they are speeding if they are going over 70mph Confused

CareerQuestioner · 17/05/2023 17:20

I was done for doing 23 in a 20 so the 10%+2 thing is definitely not the case everywhere.
