76mph in a 50 zone - what to expect

Vegasfox · 17/05/2023 16:15

My hands are in the air, was driving somewhere new for the first time today (only me in the car) and was on a 70mph dual carriage way, then I see police on bridge above with speed camera looked at speed and see on the sat nav to my horror the road had changed to 50, before I knew it back up to 70.

Iv definitely been busted in that bit of road. And feel a complete idiot!!

Anyone have any recent experience?

I know that I was speeding so if you are just popping on the tell me I could have killed someone etc please don’t, I am looking for genuine people who have experience of this.

That's not true. The 10% plus 2 guidelines mean you don't normally get a penalty unless you're going 79mph. 76mph in a 70 zone is generally ok and doesn't equal a ticket.

I really want you to go prove that in front of a few speed cameras. Heard it all now.

My local paper recently wrote up about a local who had been caught speeding at the other end of the country. He'd been doing 71 in a 70 and got done for it.

I'm not really here to prove or disprove it. If this thread shows OP anything is that it's so hit and miss how this sort of thing gets handled. It's impossible to give accurate advice. @Vegasfox Until you get some sort of paperwork for this that gives you an indication of next steps, it's really futile to seek advice online. You won't get anything accurate. It'll range from scaremongering and people calling you a murderer, to those who say you'll get a slap on the wrist.

Colleague of mine was done for doing 95 on the motorway and got a £100 fine and 3 points.

I got pulled at 88 and must have caught the delightful officer on a good day. He gave me a warning.

Arsehole speed camera did me at 34,.

Dartmoorcheffy · 17/05/2023 18:10

You should be eligible to do another speed awareness course.

TenoringBehind · 17/05/2023 18:12

Dh did similar recently. £100 and 3 points

HurryShadow · 17/05/2023 18:12

My DM drove through the M25 variable speed cameras at over 70 a couple of months ago then noticed the speed limit had dropped to 50. She said the camera flashed too on two separate gantries. She didn't get anything through the post at all!

OP - The Sentencing Council Guidelines are here - in a 50 mph the speed over which a court summons is issued is noted as 76.

If your speedo said 76, there's a high likelihood it will show at less than that on their speed gun - my car speedo always shows 1 or 2 mph higher than my sat nav's.

Based on the speed ranges you'd get:

3 points if you were doing between 51-65
4 - 6 points OR a 7-28 day disqual if you were doing between 66-75
6 points OR 7-56 day disqual if you were doing 76 or over.

Disqual's are likely to only be given if there is already points on your licence.

There are fines associated with each level too:

  • 51-65 mph - Band A fine - normally £100 but can be 25-75% of weekly income
  • 66-75 mph - Band B fine - can be 75-125% of weekly income
  • 76+ - Band C fine - can be 125-175% of weekly income

Only those in the lowest category, I believe, are offered a Speed Awareness Course.

Unfortunately now OP you're on a two week wait to see...

There is a rumour I have heard that the mobile vans don't process every ticket, just the top whatever amount they are required to get each day. I have no idea if this is true but have been past one, going too, in a similar situation while there was a temporary speed limit and I didn't get a ticket. It might just depend on how any other people were speeding that day.

Not for 76 in a 50, at that speed it will go to court, but until the OP gets a NIP its all speculation

RudsyFarmer · 17/05/2023 18:23

OP people LOVE to shit others up on here in regard to punishments. I fully expect you will get a standard fine through the post and three points. Try not to wind yourself up into a frenzy. You will NOT be losing your license.

EggInANest · 17/05/2023 18:23

You might not get done at all OP.

I have had a couple of times when I thought mobile traps had got me. Nothing!

Lizzt2007 · 17/05/2023 18:25

It's alright holding your hands up to speeding but if you hadn't noticed that the speed limit had dropped to 50 you were also driving without due care and attention. Speed limit changes are well signed on dual carriageways. Perhaps you should be considering why you feel able to drive dangerously without thought? Maybe concentrate on your driving more before you have a more serious problem. I hope you do get banned. You shouldn't be on the road until you learn to pay attention when you're driving.

Disco2023 · 17/05/2023 18:28

gamerchick · 17/05/2023 17:16

The OP said she was doing 76

Dual carriage way(A580) near Manchester has changing limits between 40 or maybe 50 ( I think) and 70. Depending on which section.

It’s been changed several times over the years. Maybe it’s a similar dual carriage way that the op has been on.

viques · 17/05/2023 18:31

I did a speed awareness course. The best advice the tutor gave was to use your speed limiter. Easy to switch off if you need to go on a motorway, but it is easy to end up going slightly above the limit in built up areas.

Lol I once commented on a speeding thread saying how it's useful to put this on if your car has it, as it's so easy to go over 70 once you're going fast. Speed doesn't really feel fast when you're cruising on a motorway. Some poster slammed me saying we're all doomed if we're relying on technology to keep us from speeding, that I'm the most selfish person in the world and should just give up my licence.
People on here can be bizarre.

User14528564 · 17/05/2023 18:38

Andy Burnham was caught doing 78 in a 40 on M62 and got 6 points and hefty fine, about £2k, he probably earns a lot though so his fine would probably be at the high end but that is worse than yours and he wasn't banned

CottonSock · 17/05/2023 18:40

I am sure I've been done before but still clean. Tempting fate!

My friend got pulled over doing similar to you. He went to court but kept his licence. He knew about it though at the time as was stopped. They might not have been recording. Don't panic yet.

I've had friends killed by dangerous drivers. I don't give a flying f* if op doesn't want judgement. She was over the max speed limit on a dual carriageway, and was even more over a lowered limit which she didn't notice. She's a dangerous driver by any standards. Dangerous drivers affect everyone. So no I won't keep my 'beak out' as you so delightfully phrased it. Perhaps if more of us condemned reckless carelessness like op has blatantly displayed our roads would be safer.

JuneShitfield · 17/05/2023 18:43

MN gets very Judge Jeffreys about speeding. Ultimately there is the law, then there are guidelines, and in reality there is also an element of dice-rolling at work too. You’ll just have to wait and see what you get sent (if anything) but my money would be on six points and a fine.

BlueThursday · 17/05/2023 18:44

I thought the phrase “key worker” was left behind in 2020

Doesn't matter what you do for a living; rules should still apply

I hate reading about these people who rely on their licence yet are sitting on 14 points

ChrisPPancake · 17/05/2023 18:44

Are you certain of the 50 limit? Down the road from me satnav says the limit is 60 but the road markings and signage clearly state 30.
Would be unusual for a dual carriageway with a lower than normal limit not to have regular repeater signs as well as the initial limit sign.

Dodgeitornot · 17/05/2023 16:53

Thats not true either, camera van did me for 74 on a clear stretch of almost empty motorway(70)) in exellent weather conditions.
Those are just guidelines and no more.
76 in a 50 limit (26mph over limit) you dont qualify for a speed awareness course, or a FPN, its court.
Court guidelines for that are a ban.
If you argue mitigating circumstances you might get 4-6 points and fine range is £100-£1000 (Band c)

You only get any leniencey if its an officer and your pulled there and then.

Speedingcalculator.co.uk sets out examples and the laws application to them

Check how long the NIP takes to arrive, ask for their supporting evidence and hope its less than 76mph!

plasticpens · 17/05/2023 18:50

Yeah, it's probably something to do with it being a potential killer.

User14528564 · 17/05/2023 18:52

You can look up if your area does the 10% plus 2, some disclose it, some don't
