Help! Told to vacate paddock within 7 days or court proceedings will start

Have no where else for our animals, our grazing licence expired Oct 2020 but the BHS legal helpline said stay put as it has turned into a common law tenancy as we have been there for 3-4 years and have maintained the land. What should we do? Any lawyers please?

I think it is the kindness of people who really, really love animals and trust that OP is naïve rather than manipulative and calculating. Not everyone thinks the worst of people.

Pretty big gamble to take. What's the chances though on a chat thread of less than 200 comments they're would be not one but TWO people offering such help that just happened to be in the exact location of OP?! If it is the case though I could certainly do with some accommodation for a couple of ponies, if you could supply the ponies too that would be great as dc are growing out of their shares. I'd really appreciate it. I'm sure you're all in my exact area to offer too...

I actually don't believe people have a right to own 1000000000s of acres when there are people and animals who have none. It needs to be distributed more evenly.

Luckily there are people who have bought large country estates but have no interest in their land but would like to see shetland ponies and donkeys frolicking there instead.

I have received more than one offer so please, I may be animal mad and a bit bonkers, but I am certainly not out to upset any farmer or landlord. The shock of the short notice got my hackles up that's all. But rather than trying to take them all on in a very futile (and expensive) way MN have a) made me see sense b) put me in contact with lovely mners. Going to wrap up this thread now and wait to see it emblazoned in the headlines Wink

What to you think you’re going to “win” in court?

Do you think the judge will give you someone else’s land?

Are you going to be able to afford £1000 a day for your legal representation then pay tens of thousands for the other side’s when you lose?

Says the person who not many posts back wanted to buy the land.

If people own a shitload of land, good luck to them, they must have the money to do it. If they can flog it at a major profit, all the better.

Hi everybody, thank you for your advice and I am sorry to say yes, I am very naiive (dim and a CF) when it comes to the law as I have never come up against it before. I can't believe I was given such poor legal advice though, I listened to it when I should have come on MN instead because there is much better advice here.

Thanks to you lot I will listen and move them before we get a court judgement (we have shetland ponies, and 2 donkeys). A very lovely poster on here through a PM has offered us the use of her horse lorry and another has some land where they can go which is actually nearer to my flat than the original field Grin.

MN saves the day. I hope this gets printed in the DFail as they like dizzy blonde Karen CF entitlement which is me. Just think, if I hadn't posted on here I would be facing a judge this time in the not too distant future and I would then have a CCJ too. Thank you straight talking Mners Flowers

You were not given “poor legal advice” !

Some solicitors give their time for free and give legal advice “pro bono” - usually through a charity and for really serious issues such as DV or deportation.

Other helplines and websites are just information.

I am not sure how the 'shock of the short notice' is a thing when you have been squatting there since october 2020.

You misunderatood the advice you were given. They told you that you could stay put until it went to court. That is true.
You don't own the land, you don't have any right to the land, but you can technically stay there until they get a court order to kick you off it. Telling you that you could stay put for now simply meant the owners had no power to physically shift you from the land.

You would not have win at court. You would not have been awarded the land, or any sort of right to stay there after the court proceedings. All you had was the option to stay there while they sorted out the court proceedings, because they need a court order to pick you off.

You, for some reason, though it meant you somehow could win the land in court. Nope. It just meant you could stay there until they could get a court to formally evict you. You were never going to be able to stay there for long, you just didn't have ti leave within their notice period.

However, staying on land you have no right to just because they don't have a court order is a shitty and stupid thing to do. Just because you can technically do it did not make it the smartest choice. You needed to move on.

I'm very glad you will now be moving. Please take your head out of your arse and treat the owners of your land a bit better next time.

I actually don't believe people that don't own 1000000000s of acres have the right to think they can and should be able to take a chunk of it for themselves as it suits. I'm starting to get a clearer picture and understand why you've possibly pissed off these people and landed a seven day notice.
