Randomly sent my P45?

I’m so confused, I work for a car dealership and have been off on maternity due to go back on 11th October, today I’ve randomly received my end of employment p45 in the post? Yet no one from my work have told me I’ve been sacked or lost my job? There are no redundancies either. I went to message my boss on our work group chat to see I’ve been removed. I’ve never had any warnings or disciplinaries nor am I on a probation period as I’ve been there 8 and a half years. Can they legally do this?

Can you find out what the niece will be doing within the company when she starts and if it is similar to your role?

Is it possible you have your return date wrong and therefor haven't returned on the correct date? I think they may then consider that as you having handed in your notice?

She definitely wasn't due back yet as her colleague asked her boss if they should do something special to welcome her back to work and the boss has lied and said OP has handed in her notice.

It would seem that the bosse's niece needed a job so they've simply replaced OP with her thinking OP might just take this and stay at her with her baby instead.What a sneaky vile sod they are.

TBF at the end of my first maternity leave I got a phone call one week later from HR saying “so I gather you’re not coming back, where do you want your P45 sending?”
My boss hadn’t bothered to tell them that I’d booked two weeks accrued holiday immediately after the conclusion of mat leave.

The only other alternative is that you’re married to an sinister bastard who’s sent a resignation email from your account. I mention the possibility only for the sake of completeness.

But dodgy bosses who need to have an entire battalion of lawyers thrown at them is the way to bet. Wait for their reply on Monday and get ACAS on speed dial.

This is weird, surely they wouldn’t think you’d just see your P45 and go ‘oh right ok I won’t go back then’ and that would be that?

Send an email in the morning saying you intend to return to work on X date.

Note that you have received your P45 and assume this is an error as you are still employed. Don’t add any more details.

It is a myth that you are protected from dismissal while on maternity. But you would be protected from unfair or discriminatory dismissal. At a minimum this sounds like an unfair process.

Check your home insurance to see if you have legal cover- immediately. If you do, they will give you details of a solicitor that can assist you.

If not, contact ACAS as others have said or get yourself down to your high street solicitor. You want to handle communications very carefully from now on.

I am sorry that this has happened. It beggars belief.

Make a screenshot of that text and save it in your personal email account as a backup piece of evidence. 🌹

This is definitely the first step to take to establish your intention, followed by a Lawyer:
Send an email in the morning saying you intend to return to work on X date.

They cannot do this this is illegal, this is also why you always sign with a union. I would look at legal advice immediately.
