Randomly sent my P45?

I’m so confused, I work for a car dealership and have been off on maternity due to go back on 11th October, today I’ve randomly received my end of employment p45 in the post? Yet no one from my work have told me I’ve been sacked or lost my job? There are no redundancies either. I went to message my boss on our work group chat to see I’ve been removed. I’ve never had any warnings or disciplinaries nor am I on a probation period as I’ve been there 8 and a half years. Can they legally do this?

That’s shocking, get some legal advice

carlywurky · 17/09/2020 21:32

Call acas in the morning. They will help you. I can't believe any business would be so stupid, especially if they have any kind of hr.

So sorry, but you'll be likely quite well off from this (I know that's not the point). Hold your nerve!

hopeishere · 17/09/2020 21:33

That's terrible. So stressful to have to fret overnight as well.

Fight it, don't let them win. I'm motor trade too and I'd be aghast if they did this to me

Keep us informed please

userxx · 17/09/2020 21:36

What? Have you actually been sacked? Absolutely not a chance can they do this.

kyles101 · 17/09/2020 21:38

Please ring acas in the morning before you make any contact with them! This is illegal!!

WorksTheDinerAllDay · 17/09/2020 21:38

Oh wow, they have made a huge mistake if they have sacked you. You will be laughing all the way to court!

Marmunia1975 · 17/09/2020 21:39

That’s sex discrimination. Get a good solicitor OP!

AppleKatie · 17/09/2020 21:42

I agree get a solicitor.

TBF this doesn’t surprise me at all though. I have a few family members who work in the trade and it is brutal with little concern for employment law at the best of times.

BadDucks · 17/09/2020 21:47

Wow that’s shocking if it’s not a mistake! Also incredibly stupid of them

snackarella · 17/09/2020 21:51

Can't wait to hear what they reply to your email.
I'm an hr consultant and this obviously shouldn't happen. If it's not a mistake you have very good grounds for compensation via tribunal

TheOnlyLivingBoyInNewCross · 17/09/2020 21:51

If it's not an error and they have actually sacked you, it's equal parts terrifying that they've done it so casually and bizarre that they think this is going to end well for them in any way! Confused What, like you'd just forget that you had a job?

Twigaletta · 17/09/2020 21:54

It seems very odd timing because surely no one's been doing your job for a year so surely better (for them) to have covered your work whilst you're away and then got rid of you. (I'm not saying they should have done this. They absolutely shouldn't. But they've lived without you for a year)
Getting a new person in after they've sent you your P45 is absolutely not going to wash with ACAS.

SausageSimon · 17/09/2020 22:03

I can't imagine this is anything other than a mistake OP, surely nobody would be that stupid!

LeaLoo82 · 17/09/2020 22:06

My colleague messaged my boss asking if they should do a welcome back table for me with a card etc just to see what they said.

My boss has told her I handed my notice in, I definitely didn’t wtf

OP posts:
Shaniac · 17/09/2020 22:08

Wtf thats mad have they mistaken you for someone else?!

mnahmnah · 17/09/2020 22:11

Has he mistaken your notice of return to work after maternity, for handing in your notice?!

Dee1975 · 17/09/2020 22:11

No no no. That’s not right and illegal. If they are making your role redundant they need to inform you, give you notice and give you redundancy pay based on your pre maternity pay.
Get in HR immediately and find out what’s going on.
Whilst they can make you redundant on maternity, you do have extra protection. I.e they must offer you any available job first before anyone else.

Tanfastic · 17/09/2020 22:16

They must be very very very dim indeed 😞 it actually beggar's belief an employer would be this dim.

yellowgusset · 17/09/2020 22:16

Shock What's your boss like? Do you think it could be a genuine mistake?

JayAlfredPrufrock · 17/09/2020 22:19

Awful behaviour.

iMatter · 17/09/2020 22:19

That's appalling!

Juanmorebeer · 17/09/2020 22:22

OP lawyer up and fight this. He is going to seriously regret that. What an idiot.

Cissyandflora · 17/09/2020 22:22

This is bloody awful. I’m anxious just reading your posts. Glad you’ve got some good colleagues. I had something similar happen. Lost my job. Found out in same way as you. Was very pregnant. Good luck fighting this.

LeaLoo82 · 17/09/2020 22:23

My boss is okay but a massive arselicker. We’ve never once had bad words though that’s the thing I’ve got a text from my boss in early August saying looking forward to having you back
