Sandie Peggie: Employment Tribunal, associated legal claims, and related matters - thread #68

nauticant · 04/10/2026 13:02

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

A second Employment Tribunal, Sandie Peggie vs Royal College of Nursing, has just been heard. The hearing started on Wednesday 23 September 2026 and ended on Thursday 1 October 2026. It is possible that a decision will be handed down before Christmas of this year.

Additional legal claims have been raised. Sandie Peggie is taking action against three senior managers who were witnesses in the first Employment Tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

I see we are at the stage where a person advocating for some spaces to be separated by "genitals" also thinks it's "obsessive" to advocate for that.

Same person who is going to read people's posts to decide whether or not to read them, is it?

Kirschcherries · Today 17:54

I have been explaining why gender incongruence is a real psychological phenomenon and not an "ideology", why words are not facts, and why recognising someone's gender is not "lying ". I haven't waded into any discussion about how to organise psych wards and prisons.

Edited

This thread and the previous threads are about employee single sex changing rooms in an NHS hospital.

One example given why the guidance is correct is of the awful repercussions for a transman placed on a mens psych ward in an NHS hospital.

On a previous thread you posted (06/10/26) - The problem is that you are assuming your understanding of "women" etc is the "unambiguous" one. But not everyone shares your definitions and values. To me a sign saying women is "unambiguously" for women and trans women.

To be fair I will ask you two direct questions

  1. Do you believe transwomen should be placed in women’s prisons, women’s psych wards? They have signs saying women’s.
  2. Do you believe transmen should be placed in men’s prisons, men’s psych wards? They have signs saying men’s.
BlueLegume · Today 18:10

Start your own thread Laxy. You wade in with incoherent nonsense on too many threads that relate to women’s spaces then disappear.

Start a thread explaining your opinion. How you have the time to do this with school runs/work presentations/feeding the kids is beyond me. Let alone the posts in the middle of the night. It is beyond ridiculous.

Kirschcherries · Today 18:12

Sorry I shouldn’t rise to the bait.

So you think separating by sex is regressive but you are not advocating for all things to be mixed sex so what are you proposing? Not mixed sex, not single sex so what is the alternative/ are the alternatives? Outline what this brave new world should look like.

I don't think there need to be universal rules about how we organise different spaces. I was fine with how things were before this very recent development where we seem to be becoming increasingly obsessed , particularly in England , with legally mandating the segregation of people by their genitals in all kinds of settings.

StealthTroublemaker · Today 18:31

Lacksie · Today 16:45

No I'm not advocating for all spaces to become mixed. Why would I do that? I'm just really disturbed by the obsession that we seem to have developed in the UK of legally enforcing the organisation of people according to their genitals .

You said sex segregation was regressive. Therefore to be progressive we must end sex segregation, which would mean all spaces were mixed sex….. are you saying you didn’t mean that?

So you don’t want sex segregation? I’m confused now. In one hand you’re saying sex segregation is bad, but you still want to have sex segregation but you don’t really want it because people do want it. Are you ok.

It's fair to say it was a throw away comment too absolutely expressed. I'm not opposed to any sex segregation in any context. What I find regressive are the recent developments in the UK- particularly the EHRC guidance, and all the consequences that are rolling on from that.

And I was fine with how it was for centuries until about 15 years ago when men started thinking they had actually become women just because they were wearing a frock.
Yes, I am obsessed with legally separating male and female people because it's necessary to provide safety, dignity and privacy in a civilised world, especially for females.
Sorry Lacksie but I am absolutely delighted that things are rolling back.

Yes this is exactly what I find regressive.

why is sex segregation now regressive in the UK? Do you mean because males are no longer allowed in female spaces? Surely that progressive for women?
I mean, Oxfam are campaigning for sex segregation of toilets in India and Pakistan. Are they being regressive? Or are they aware women need sex segregated spaces for privacy and dignity as well as safety?

DustyWindowsills · Today 18:44

Sex segregation of public toilets had become the norm by the time my grandmother was a young woman. It's odd to see it described as a "very recent development".

spannasaurus · Today 18:45

The Equality act doesn't allow for "sex segregation " in all contexts just when it is a proportionate means of achieving a legitimate aim.

Separate sex Prisons, hospital wards, changing rooms, rape therapy groups and toilets are all considered a proportionate means to achieve a legitimate aim.

I doubt oxfam are advocating for the kinds of policies we are currently introducing in the UK.

Yes, yes they are. Single sex spaces for women where no males are allowed. They are actively campaigning for toilets especially to be single sex. So are they wrong in your opinion?

The policies we are introducing in the U.k are no males in spaces designated for females only. Why is that regressive? What is the alternative? .

No, they are not advocating for policies akin to the EHRC guidance.

This is bog standard motte-and-bailey pretend engagement.

Make a broad and sweeping statement, ie the motte. Get push back which means people have been drawn in. Retreat to the bailey and then point out the unreasonableness of those posters arguing against the scope of a perfectly reasonable bailey. Rinse and repeat.

Not a game I'm interested in.

Well said @nauticant

@Lacksie start a thread based on whatever is your opinion. This thread relates to Sandie Peggie. Nothing you contribute has any bearing to Sandie’s situation. It is really easy to start a thread of your own.

I cannot understand if you have so much opinion and passion why you do not start a thread of your own.

Can you answer that please?

Hedgehogforshort · Today 19:03

I am surprised to learn we are segregated by virtue of our genitals. Based on that assertion, then people who have had there ‘genitals” surgically altered, should go in to services according to a genital inspection. Oh yes!!! I am following the TRA argument now.

but of course we are not “segregated” by virtue of that, we can expect separate sex services, where appropriate due to our biological sex which is more, than just our genitalia.

@Lacksie you so very give yourself away as the biological male, and TRA, that you are.

I'm simply contributing to a conversation that plenty of other people are having . People talk about a subject for a while - no one complains- as soon as I comment - I'm suddenly " derailing" . Even if I am discussing the SP case I'm apparently "derailing". It's entirely transparent.

.It’s bonkers that you think I must be male simply because I disagree with you. Just because I have XX chromosomes and reproductive anatomy that has enabled me to give birth to several children, that doesn’t mean I’m obliged to agree with you. Women are individuals with their own thoughts, beliefs and opinions. We don’t all share one collective brain.
