From the reports circulating, Thomas Markle Jr. claims he discovered suspected child sexual abuse material among stored family possessions in the Philippines and reported it to the authorities, including US agencies.
However, there is a crucial distinction between finding material on devices associated with someone and proving that person downloaded it, knew it was there or committed an offence.
His sister, Samantha Markle, has accused her brother of fabricating the allegations, allegedly for financial gain. She also claims that the computers had been transported from Mexico and stored in the Philippines, outside their father's control for around two years. If that account is accurate, it raises legitimate questions about who had access to the devices and when.
As far as the publicly reported evidence goes, I have seen no independently verified forensic findings establishing who downloaded or accessed the alleged material, and no reported charges against Thomas Markle Sr.
Of course, Samantha's accusations against her brother are also allegations, not established facts.
The distinction is important: reporting a suspected crime can justify an investigation, but it does not establish guilt. A US prosecution would need admissible evidence supporting the relevant offence, with guilt ultimately proved beyond reasonable doubt.
So, for now, there are serious allegations, a reported investigation and a family dispute over the credibility of the claims. Until the forensic evidence and chain of custody are established, it seems premature to conclude that Thomas Markle Sr. was responsible. It's one hell of a mess.
