Help with holiday entitlement

Need some help understanding annual leave.
I am a part time worker I work 22.hrs per week Monday to friday.
My annual leave year runs from 1st Jan to December 31st.
My contract states 28 days that's including bank holidays.
Having problems understanding how to work out my entitlement.
So for example last year I took 10 days annual leave,then I took a further 8 days a few weeks later,which was all approved,the 8 days I didn't get any annual leave pay at all as I was told I'd gone over my annual leave entitlement,
I have been told to look at my wage slip each month to see how much I've accrued each month.
So for example I've looked at my most current wage slip of end of Feb and so far I've worked 2 months and accrued 132.00 of holiday,I've been told my hoilday is based on hours but the accrued holiday on my wage slip is 132.00 which is in pounds,
Please if I am wrong,I thought you only had to accrue holiday if you are new to a company or started part way through the year,I have been at this company for 5 years,if anyone can help me work out my annual leave and does 2 days or 9 hrs seem enough annual leave for working 2 months so far this year?

Similar situation as me
Holiday year 1st Jan to 31st Dec. Standard is 26 days holiday plus bank holidays.
I work 30 hours over 5 days - Mon to Fri.
My business works out holiday in days not hours as I work every day of the week.
I get 26 days leave but at 6.5 hour days not the normal 8 hours everyone else gets.

I go through the same conversation with HR ever Jan 1st as the holiday system automatically deduces me holiday days as it assumes I have to take the full 8 hours when I book a day off not the 6.5 hours I actually work. They have to correct it every year.

How did you get this rectified please,as I just have an app i just choose the dates I want off

I emailed HR explaining that I should have the same amount of 'days' as a full time employee but my 'days' are 4 hours long. They agreed it was an error and switched it so my annual leave appears in hours so 4 hours x 28 = 112 hours per year. Each day I book deducts 4 hours. I also get bank holidays on top of that but that is separate to the 112 hours.

I think they’ve recorded each of your holiday days as 7 or 8 hours, the same as they would for someone who worked part time by working fewer normal-length days. And of course it should be 4.5 hrs for each day for you.

As you have 126 hrs holiday (4.5 x 28). If you had taken 18 days and they recorded it as 7 hours per day, then it would say you’d taken 126 hrs holiday, ie all gone.

OR they’ve calculated your hours entitlement wrong.

Their spreadsheet only proves they’ve calculated it incorrectly somehow. They need to show you what your entitlement is in hours, and how many hours leave you have taken and when.

The having to ‘earn’ holiday before you take it, as a non-new employer, is a separate matter (doesn’t sound right to me but I don’t know about those things).

If you can pull out a payslip and check what you were paid in months where there were bank holidays and months where you had sick days, this will help.

On the face if it, to me it looks as though they are accruing your leave incorrectly each month.

What happened in April? Why have they said you accrued so little holiday pay that month?

They also seem to be saying you accrue less holiday pay in any month where you take holiday, presumably because they are saying you are working less that month - but this seems to be double-counting.

I also don't quite understand how you can possibly only use leave after its accrued - how could you ever use the leave you accrued in December? You seem to start again from 0 in Jan.

If they are solely basing your entitlement on hours worked and not including days taken off sick or when you took annual leave then that is also incorrect.

Basically it looks like they are incompetent.

Important question. I suspect this may be where there calculations are going astray.

When I was paid the 10 days holiday I got 540.00 so 10x54 = 540.00 so that was correct

They arent accruing your holiday pay if you take a holiday.

If they use this system for everyone then other staff will be affected too.

Agreed.

If you work shorter days but every day then you sul get the sane number of days holiday. Just your day is a short day.

In theory it should be in hours in case you want to take a half day (ie 2 hours)

I'm thinking you might be best to contact ACAS about potential underpayment of statutory leave and get their advice. Without seeing your entires years worth of payslips etc it's impossible on here to give a defininitive answer but ACAs might be able to help.

If there is anyway I could contact you,as your exactly the person I need to try and get to the bottom of this,I could send you my years worth of last years wage slips

Rate = £12 ph

Holiday pay accrued each month = £90 (accrual rate 8.33% based on 20 days leave per year as excluding bank holidays)

But the breakdown they have sent you shows you have accrued less than that each month.

Do keep questioning them as what they are sending you doesn't stack up. Either they or their software provider should be able to explain how it should work (and show you with figures that it does work in your case).

Where I have been In touch with acas,I think things are a bit frosty now between me and my company,as the conciliation officer had to ask my permission to get in touch with my company,In the mean time of waiting to hear back from the the conciliation officer,I did email my boss asking what type of benefits it has to doing it like this and wouldn't everyone in the company be taking annual leave around the same time,I work on my own so I do not work with any other employees,but I think where acas have emailed my employer,he hasn't responded to my email

I am not a lawyer or even qualified in HR but I do run payroll for a company employing approx 30 people.
