Help with holiday entitlement

Teddy0822 · 11/03/2025 10:31

Need some help understanding annual leave.
I am a part time worker I work 22.hrs per week Monday to friday.
My annual leave year runs from 1st Jan to December 31st.
My contract states 28 days that's including bank holidays.
Having problems understanding how to work out my entitlement.
So for example last year I took 10 days annual leave, then I took a further 8 days a few weeks later, which was all approved, the 8 days I didn't get any annual leave pay at all as I was told I'd gone over my annual leave entitlement,
I have been told to look at my wage slip each month to see how much I've accrued each month.
So for example I've looked at my most current wage slip of end of Feb and so far I've worked 2 months and accrued 132.00 of holiday,I've been told my hoilday is based on hours but the accrued holiday on my wage slip is 132.00 which is in pounds,
Please if I am wrong,I thought you only had to accrue holiday if you are new to a company or started part way through the year,I have been at this company for 5 years,if anyone can help me work out my annual leave and does 2 days or 9 hrs seem enough annual leave for working 2 months so far this year?

@Teddy0822 is the £89.688 not for the accrued holidays? Not sure what the £132 relates to. Do they owe you that money in holiday pay

Comefromaway · 11/03/2025 11:24

It doesn;'t matter, it's just that it's such a convuluted method that most only use it for irregular workers. we used to have a holiday fund but that was because we were part of a construction industry scheme called Welplan whereby we as a company bought Holiday Credits based on various things. I was so glad when they stopped that.

But I think your company have calculated things incorrectly.

I've run your thos months figures through my payroll software and if you have worked 99 hours this month then this month alone you have accrued 12 hours holiday which based on your hourly rate of £12 equals £144

I work 22.5 hours a week over 3 days I get 143 hours this is for the whole year and I can book a year in advance and not just accrual each month.

dementedpixie · 11/03/2025 11:26

If they didn't pay you for holidays as you hadn't accrued them then they should have let you take more holidays when you had accrued the days or should not have authorised your leave. You didn't get your full entitlement of 28 days paid leave.

See I'm being told I have to accrue the holiday, yet I've been at my company 5 years,I asked the question to my company that as soon as the 1st of January comes if i wanted to I could take off my whole annual leave entitlement,I was told no you can't do that

@Teddy0822 i cant really understand it at all but I'd be querying why they aren't giving you your full annual leave entitlement.

Comefromaway · 11/03/2025 11:32

Do you have an annual shutdown? We shut down for 2 weeks at Christmas so we contractually make our employees save 10 days out of their holiday entitlement for that. I'm wondering if your company is only showing your days you are free to take when you wish as being accrued and are deducting bank holidays and annual shutdowns?

Iloveeverycat · 11/03/2025 11:33

This is what it states online if you look it up.
After your first year, you can use your full statutory holiday entitlement from the start of your leave year.

dementedpixie · 11/03/2025 11:37

So maybe £132 is the holidays you accrued in January and £89.688 is what you accrued in February? Added together would give £221.688. Divide by 12 and then 4.5 = 4.1 days accrued (maybe)

No shut down over Christmas, just Christmas day and boxing day that's it

Looks like accrual system should only be used in the first year and then you can take annual leave from the start of the year in the years afterwards (if working the same regular hours)

Maybe it could be,I want to see if my march wage slip will state this,as I wanted to see what my February one said, but if I have only got 2 days holiday so far,how I am seeing it,I'm getting 1 day holiday per month,so I have to work another 3 months to gain 5 days annual leave, that's how I'm reading it at the month, and if that is the case,by may if I had 5 days,I have to work another 5 months to gain another 5 days holiday, that's 10 days which will take me up to September so where will be the other 10 days I can take, can you see what I'm getting at here?

You need to ask them how do they calculate the amount accrued each month. It should be 12.07% but I am certain they are excluding bank holidays. The explanation given to you posted upthread is not clear at all and that's from someone who works in payroll.

Comefromaway · 11/03/2025 11:48

You should be accruing 1.66 days holiday per month or 0.38 days per week (plus your bank holidays)

MikeRafone · 11/03/2025 11:49

Teddy0822 · 11/03/2025 10:58

This how I am being told to work out my annual leave,so in my previous comment I've worked all through January and all through February and so far all I have annual leave wise is 9hrs holiday so far, does this seem right

This has 4 hours per day, not 4.5?

dementedpixie · 11/03/2025 11:49

What does your January payslip say?

dementedpixie · 11/03/2025 11:50

She put 4. So I assumed it should be 4.5 hours and she'd missed the .5 out

The typed out sheet says its an example and not related to OPs actual hours or pay

Thank you for doing that,I've put on here an example of how my company have told me to work out my annual leave and I've been told it's down to me to work out my own annual leave, shouldn't they be keeping a record of how much an employee is taking,I took 10 days in October last year,I then went back to work for 17days then took the 8 days annual baring in mind all this annual leave was approved by them,I had no one contact me at all,to say I was not intitled to this,as again I would of queried it,it was only when I received my November pay slip, the 8 days was not paid,so got in touch with my company and was told straight away it was right, and that I 0 balance, that's why payroll didn't pay me the annual leave

I'm thinking you might be best to contact ACAS about potential underpayment of statutory leave and get their advice. Without seeing your entires years worth of payslips etc it's impossible on here to give a defininitive answer but ACAs might be able to help.

That's why I am not understanding this on my current wage slip which it says accused to date 132,I get 54.00 per day so 54 + 54 Is 108.00 so that's just over 2 days or 9hrs annual leave

OP posts:
dementedpixie · 11/03/2025 11:59

@Teddy0822 so how many days paid leave did you get last year? Just bank holidays and 10 days in October? And 8 unpaid days? Did you have any other annual leave? I'd be raging at being underpaid for my holidays.

Teddy0822 · 11/03/2025 12:02

I have been in touch with acas,I put in an early conciliation,my employer responded to them and said am not owed any money, this was my employers response
