Feminism: Sex and gender discussions

It's always interesting how hard some posters will work to make this into another and more comfortable issue.

The hospital is tiny
Female doctors can't be guaranteed
It's unreasonable to want a female doctor.
Chaperones

It always suggests that to face the real issue would be too uncomfortable to discuss. The real issue is that a woman was told she could have a female hcp, so her wish and need was respected and this was fully in the staff's belief they could provide, AND THEN a man who identifies as a woman was sent to her as 'a female hcp' due to his personal identity beliefs. So this was intentional: that a man with a gender identity is counted as being actually female when a patient expresses that wish.

So the intent was to either deceive the patient and hope she wouldn't know (a bit forlorn hope really) or to expect that a woman would 'respect' the man's identity above her own reasons and needs expressed for a same sex hcp.

This entirely privileges the man's choices, feelings and self expression above anything regarding the woman patient he has power over and responsibility for. It cannot be that hospital staff do not understand the needs or reasons why women may wish for same sex care. Or the vulnerability of putting a woman in a position of having to say 'no, you're a man'. Or the distress it may cause that woman to be confronted with a male intent on making her join an illusion he is female when her body knows he is male. It puts politics above patient care, it destroys trust (as seen by the husband then feeling he could not leave her), and it entirely disregards the whole concept of informed consent.

I'd think if she chooses to take this to court, she's probably got him. Activists arguing that the woman's needs and feelings are just prejudice is basically 'his stuff matters and should be accepted without question but hers shouldn't'. And this is straight forward medical consent and a patient, not an employer managing colleagues this time.

Chaperones don't change the situation for a woman who has asked for a same sex hcp and has been told yes, you can have one, with an attempt to then deceive / mess with consent by sending a biological male in the illusion or political requirement to pretend that he is female.

Why cannot a professional, supposedly interested in patient care and inclusion, accept that some patients are not for him to express his identity on?

Edited

Either he, or the hospital, or the both of them, hope that something in what he has done via transitioning treatments, surgeries and so on, or the 'sharedness' of hopes and beliefs in the situation created between him and patients, will somehow make him into a woman for this purpose?

At that point it seems to me, it's gone a step beyond politics, into religion. Or magic.

@Helleofabore

I am not playing ‘who has best knowledge of Australia’. However, I am questioning now why you have persisted in referring to a regional hospital as ‘tiny’. Your sense of size seems very off.
John Hunter is also a major teaching facility attached to a very reputable university and servicing a very densely populated region. I also don't know how you consider Newcastle not to be a major city of NSW. But well, perhaps you don’t consider Lambton to be servicing Newcastle, the Hunter and the immediate central coast between Sydney and Newcastle, then I get I now can take your statements about size to be indicative.
For some reason you sought to dismiss this incident. Fine. But in doing so you are showing that you really don’t seem to show much understanding of hospital services in rural Australia at this point.

This is getting really weird at this point.

To compare PM Hospital to John Hunter, yes, it is small. You take issue, then, with “Lambton to be servicing Newcastle … etc”. Do you live there? Are you aware that Lambton is a suburb of Newcastle? Or did you just copy and paste some statement you found on a web page?

Newcastle is a city of NSW, but not the capital city. In my post, I wrote “ohn Hunter isn’t even located in a major city, but draws patients from a number of regional areas,” meaning it is a tertiary hospital for a number of regions NOT located in the capital city.

My first post was only pointing out that generally patients cannot request female doctors in the ED in Australia. This seems to be a flaw in the article. Take it or leave it, but there’s no need to keep poking at me in this way.

My first post was only pointing out that generally patients cannot request female doctors in the ED in Australia.

I don't believe this can possibly be true. A patient can always request a same-sex HCP. Whether they get one or not is down to availability but they can always make the request.

I've worked in similar sized EDs in the UK with around 150 patients per day. At any given time there were always multiple doctors on shift. As over 50% of doctors are female the chances are always very likely that a female doctor will be available if requested. Certainly far more likely than for a female patient to request to be seen by a trans identifying male.

Newname26 · Yesterday 13:18

I think regardless of the size of hospital or number of doctors available.

If someone requests a female doctor, there are 2 options, give them a actual full blooded female or explain your are sorry no females available, you can either accept a male with chaperone, transfer to another hospital or wait until shift change when the next female is available.

You do not fob them off with a man pretending to be a woman. A man touching you without consent should be classed as assault

GailBlancheViola · Yesterday 13:20

Her family claim that fears she would be ‘bullied’ into accepting the 6ft doctor as female meant her husband refused to leave her bedside.

THIS is the point - in what Universe is it ever acceptable for a patient to fear being bullied when accessing health treatment? The fear being so great that the patient's husband refused to leave her side to snsure that his wife would not be bullied. That is disgraceful.

Trouble seems to follow Dr Upton around, when is it going to be realised that the problem is him and not everyone else?

Regarding whether a female HCP was available or not is not the issue, the iussue is that the patient requested a female HCP and had the patient been told I am sorry there are no female HCP's available they could then have made an informed decision as to how to proceed, but insisting to the patient that the male HCP Dr. Upton was female is deceit and drives a coach and horses through informed decision making and consent from the patient.

Anyone defending this is showing a total and utter disregard for patient safety and consent. The patient is supposed to be at the heart of healthcare provision.

Imdunfer · Yesterday 13:30

I think it is much worse that Dr Upton insists that they are not only female but he has a "same sex" wife.

Not only are women being told that they have to accept that he is female when he is male, but he is also sexually attracted to women's bodies.

I wonder at what point Dr Upton regretted going after Sandie Peggie? Can’t say I have any sympathy for him.

One of Upton's complaints was that he & his wife had suffered homophobia as they were both lesbians.

Fantastic co-incidence that Zoe became a lesbian at the same time as Theo became Beth. Phew, bet that was a relief to both of them.

I'm no Mystic Meg, but would be willing to wager a sizeable sum that: (a) it won't last between Dr Upton & his other half; and (b) If and when she goes back 'on the market', her lesbianism will have evaporated.

It's one of the most barking bits of the trans stuff, isn't it?

A heterosexual man who says he feels like a woman but he's sexually attracted to opposite sex bodies, so he obviously must be a lesbian.

Mate, you're a bit of a feminine heterosexual man who feels more comfortable living as a female stereotype. You ain't a lesbian.

There is nothing more homophobic than a man declaring he is a lesbian, it is repellent.

Well of course … except that since Aus law appears to say quite explicitly after Sall Grover’s defeat that transwomen are women, it seems impossible for hospitals to admit that someone like Beth/Liz Upton is male without breaking the law. So even proposing a chaperone could be problematic.

Not to mention that the chaperone could also be a TW. For the same reasons.

Until ordinary people in the country have had enough of this madness and insist on changing the law, it looks as though Upton and other males will be able to do as they wish.

That's one hell of a catch 22.

Patient can ask for a female.

Hospital can't tell patient he's male or they're breaking the law.

Hospital can only get round this by requiring all female patient facing staff to register sex at birth and calling on one of them, but nobody can be forced to provide that information. Hospital can request female staff to register as CIS but gender critical women won't do this as a point of principle. It would rely on enough women being prepared to do it for one always to be available, but a lot of women also won't agree with excluding a male trans person from examining a woman who has asked for a female doctor, so won't do it. And the trans male could possibly still claim discrimination.

How on earth do Australia unwind that shit show?

We all heard this unpleasant man in the tribunal. If he'd behave himself, he wouldn't be in the news still, would he. But he won't so he is.

Is the constant hounding of women saying they need want and deserve single sex spaces really necessary? Was it really necessary to hound Sandie Peggie because she complained about a male in the female changing room…. Why is one ok but not the other? Either both are wrong or neither.

The claims that Dr Upton insisted on using a changing room where he knew he was making women feel uncomfortable were proven.

The fact that he complained to the hospital management about a woman telling him she was uncomfortable about a man using the women's changing room was established.

The fact that he is still putting himself forward to do intimate examinations of women who have asked for a female doctor seems proven.

And the "hounding" of all cases like this will be necessary until all women have a right to know whether they are being treated by a doctor who is a male or a female.

Claims that Upton personally sexually harassed Sandie were dismissed but the whole case is being appealed. I cannot see how they can find that Fife harassed Sandie by allowing Upton into the female changing room but then find Upton innocent when it was him doing the harassing.

If Upton hadn't been such an entitled prick as to think it OK for a man to use the female changing room just because he said the magic words "I'm a Laydee" then we wouldn't be here still discussing his gender transgressions.

It’s completely self-inflicted on his part. If he has the intelligence to become a doctor, he should also have the intelligence to know when to say ‘no’ and keep himself out of trouble, but he doesn’t, so not only does this call his character into question, it also makes him fair game.

Helleofabore · Yesterday 15:58

I think it is actually pretty clear that Upton lacks the ability to self-regulate and to take the needs of female people into consideration. That he was clear that he would present himself to a female patient who asked for a female doctor and then expect that patient to have to reject him or to accept him with him knowing that he was male (as after all, he IS a doctor).

Meaning he was demanding a female patient, who has a quite high chance of being a vulnerable female patient, decide whether or not he was 'female' and whether she would risk being negatively treated for rejecting him.

It is unconscionable behaviour, in my opinion. And no health authority should be allowing this under their policy.

"Just a reminder that all claims against Dr Upton were dismissed."

What he admitted under oath, was that he would act in ways that put vulnerable female patients at risk of harm. All legal claims might have been not upheld for now as per the specific tribunal, but 'claims' that he is a doctor who acts without due regard for his female patients or his female coworkers? No, I don't believe they were 'dismissed'. I think it shone a bright light on who he is.
