Nick Wallis - journalist and he of the Gender Blog is live tweeting the Criminal Case brought by CPS.

Per Nicks blog post:

I am attending R v Matthew Heath, at Stratford Magistrates Court. Heath - known to many on X as Legal Gengar - runs the Grift Watch website. He is charged with the harassment of Stephanie Hayden.

Hayden has already had a pop at Heath through the civil courts, dropped his case and now owes him £35,000. Payment is due this week.

This case is a criminal case and therefore an entirely separate process. The hearing will start with a bad character application by Heath's legal team with the aim of getting the case thrown out.

If the district judge sitting in this case refuses to throw the case out, Heath will stand trial immediately afterwards.

No hope that an intelligence virus will sweep over the CPS, and they'll drop the case against Gengar and instead start one against Hayden for Wasting Police Time?

I want to hear more about that £35,000 payment. I bet Hayden won't end up paying anything at all.

MH still has the bankruptcy proceedings against Hayden ongoing, so that’s something. FT seems to have an inheritance coming his way so having funds will presumably mean he has to cough up.

The Farmers have had a few comments today - apparently some of the alleged SM harassment was on their patch.

For those not on X, Matthew’s solicitor has posted some highlights from yesterday. Hayden, as a witness, was not in the courtroom but it seems that someone was updating him during proceedings.

I may be misunderstanding Nick Wallis’ tweets, but I think the judge has asked for an in-house prosecutor for when the trial goes ahead in October.

I may be misunderstanding Nick Wallis’ tweets, but I think the judge has asked for an in-house prosecutor for when the trial goes ahead in October.

I felt sorry for the prosecutor who is not an employee of the CPS he is an agent and had no access to the CPS management files.

The judge did order that an in house prosecutor was to be provided (someone employed by the CPS) so that they can access information on demand.

I am not procedurally savvy, but was surprised that he accepted the BCA, on behalf of the CPS so they will be stuck with that at the actual trial.

it means in this case that the defence can introduce evidence of the complainants behaviour, criminal record or other activities that shed a light on the complainant’s motives

in this case i would imagine it relates to Hayden’s propensity to sue people, and also his own twitter account activities which have been abusive.

i find it hard to understand why the police and CPS proceeded given legalgengar won against Hayden’s civil action, of a similar vain.

this is becuse the burden of proof is much higher in criminal proceedings

Legalgengar has all the receipts so popcorn will be required at the actual trial.

I believe it means that the court can be told about Hayden’s past behaviour and to challenge his credibility.

I'm afraid not. I would like to be able to do things like voice my feelings about yesterday, explain the law, answer questions, etc. but I can't do any of that for legal reasons at the moment.

I’m so pleased that Nick Wallis is on the case. His journalism on the Post Office scandal was eye opening.
