Why are the Respondants so automatically determined to oppose these recusals? Why not just stay neutral on the matter? Feels like they are just being combative for the sake of it and wanting to curry favour with panel, rather than wanting the fairest outcome and entetaining the possibility that they may have a point.

I think the point about MM and NIPSA here is not what he thinks, believes or even did or didn't do while he was TUS Whitley, but that there were many times last week when it would have been the right, transparent and advisable thing to do to out his hand up and point out the potential for him appearing to be at risk of bias.

This could have been raised, discussed, acknowledged and discounted.

It is the fact that he did not, at any point, when seeing the NIPSA logo on the bundle or hearing SM evidence about sss think, 'oh, I did forward a lot of emails and collate a response about that a few years ago, best point that out.'

I don't think he is there for or as NIPSA.

He is in the panel pool with that experience as context.

I think he’s retired from NIPSA.

But the suggestion he’s the guiding hand on policy that allows biological women into single sex spaces allows for a clear inference of bias.

I can't imagine NC overlooking this point though so maybe there is a work around (eg in the case of sickness at a late stage in proceedings?)

That is an incorrect analogy. Unlike the example, it is not an aside to the case here, it is at the centre of the case. SM spoke out about women’s rights, and how Trans Ideology is trampling over women’s rights as a sex class. MMcK appears to be involved in his Union pushing the ideology which is damaging to women’s rights. He appears not to be neutral or non-partisan on women’s rights as he apparently was (is?) involved in pushing for trans ideology to over ride women’s rights.

I did wonder this, especially as NC's case going so well.

I realise there are cost implications involved in starting again, but given that it looks like his side are losing and they would get another bite of the cherry if it halted, why is he so keen to oppose?

It's evidence (maybe slight) that he doesn't think it's an issue - that TWAW (as a shorthand) is an unremarkable position, something neutral, part of the wall paper. It never occurred to him to raise it.

That's a problem.
