No more investigatations into 'non-crime hate incidents'
In a statement, a Metropolitan Police spokesperson said that "we understand the concern around this case. The Commissioner has been clear he doesn't believe officers should be policing toxic culture war debates, with current laws and rules on inciting violence online leaving them in an impossible position.

"As a result, the Met will no longer investigate non-crime hate incidents. We believe this will provide clearer direction for officers, reduce ambiguity and enable them to focus on matters that meet the threshold for criminal investigations.

"These incidents will still be recorded and used as valuable pieces of intelligence to establish potential patterns of behaviour or criminality.
"We will continue to investigate and arrest those who commit hate crimes - allowing us to comply with statutory guidance while focusing our resources on criminality and public protection."

I heard this on R4 PM too.

I was at the Battle of Ideas festival at the weekend and went to the 2 tier policing session.

A couple of people called for an end to Non Crime Hate Icidents. Sarah Phillimore was on the panel and said that we don't need to worry about them anymore because challenges by Fair Cop etc meant that they were a dead duck.

She said that there were other, bigger problems, to worry about like people having actual crimes recorded against them without them necessarily knowing. It has happened to a couple of people already. If I remember correctly, Helen Joyce is one.
I think Sarah Phillimore was live tweeting but I don't have a link to her Twitter thread.

Great news that the @metpoliceuk will no longer investigate non-crime hate incidents -- a direct result of our successful campaign to get the Met to drop its investigation of @glinner, which it has now done.

This is a tremendous victory, but the war is not yet over. We now have to make sure all the other police forces in the UK follow in the Met's footsteps and they all now stop recording NCHIs, including the Met, in a way that means they can show up in enhanced DBS checks and prevent you from getting a job as a teacher or a carer. No one should be prevented from getting a job because they've committed a 'non-crime'.

Nevertheless, this is an important step on the road to scrapping NCHIs altogether, something our director, Lord Young of Acton, called for in the House of Lords last Thursday. He has proposed an amendment to the Crime and Policing Bill, co-sponsored by Lord Hogan-Howe, a former Metropolitan Police Commissioner, to abolish NCHIs.

No, if someone commits an actual crime it will be investigated.

If someone hasn't committed a crime it won't be investigated.

Previously someone could report you for non criminal acts and you could have a NCHI recorded on your records without you even being informed about it

It's not actually illegal to be racist - or sexist, misogynist, homophobic or transphobic. It's illegal to beat up, rape or kill people and a "hate crime" is to do any of these things BECAUSE of someone's protected characteristic. (Well except if it's because they're a woman of course)
NCHIs are about policing people's thoughts and beliefs. It's not ok to do this. Especially without even telling them.

That hasn't actually changed. The Met have only said they will no longer do follow up investigations.

Exactly. We are allowed to hold views. Some might be distasteful or offensive (and offensiveness is a subjective concept to start with) but it should never be the role of the state to criminalise unpleasantness. How did we manage in society 25 plus years ago?

This happened to Sarah too. She was unaware until some TRA boasted about it on the then Twitter, did a FOI request, and challenged it legally.

It was expunged, if I remember correctly, but the travesty is that it should have happened in the first place.

Graham's trial for alleged harassment of a trans identified male and criminal damage to the man's phone continues on October 29th (next week).
The charges stem from a series of events in October 2024 at Battle of Ideas.

So its okay now to make hate comments re protected characteristics- ie calling a black footballer the n word, the facial characteristics of someone from east Asia?? There will be no consequence??
