NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #47

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence had been intended to be 28 July with 2 days of submissions from counsel meaning that the hearing was to have ended on 30 July. However, it became apparent as the hearing progressed that this schedule wouldn't be followed. (Considerable understatement.)

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

I agree the use of those 'descriptive, geographic terms' varied and probably still does vary according do the part of the country you're from. My elderly father never could understand the horror reaction he got when he talked of 'the P*ki corner shop'. He couldn't see it as abusive at all, whereas my sister and I could hardly believe our ears (having become Londoners, by virtue of long residence, by that point).

Sometimes I wonder if people know how to read opinion polls. Something like 80% of the electorate think that current immigration levels are too high. It might be a higher number if you're specifically talking illegal immigration.

I make no value judgment about that, it is what it is. It's just that I encounter people who think most of the population is in favour of essentially unlimited immigration, that if you're not you must be some kind of Tommy Robinson fan, and who are totally convinced that they're not in a bubble.

I think Brexit would tell you that at least 51% of the population think immigration, legal and illegal are too high.

Not really. Isn't it standard practice nowadays to address women as Ms unless you actually know they prefer Mrs or Miss? Unless they're Dr, Prof etc, obviously.

A lot of Irish people were on the receiving end of racist jokes in England and it left us more aware of how unacceptable it was - made easier for us by very low levels of immigration until about 20 years ago. Hence I suspect Marie's family (and mine) steering clear of racist 'humour' - it wasn't generally used. otoh, there was some very nasty stuff about Travellers.

ps, no nasty stuff in my family, and I never saw it in an email chain, but there'd be the odd overheard comment.

They do need to be challenged, but they aren't relevant in this case at all and thus don't need challenging in this case. It's a smear campaign because they have nothing else to try and pin on her.

Racism and not wanting to share a female changing room with a man are totally different things.

I agree that racists need female only spaces too.

But there's a lot of people on here defending Peggie saying she used the P word when she was younger.

But she's an adult and still sending racist memes.

Why is JR so desperate to know who is funding the case, I wonder? If our general assumption is correct, it doesn't appear that it could do her case any good. Is she hoping the money is coming through Sex Matters perhaps and hoping to use that to smear NC? Or does she think (or know) that it comes from other source, one she could categorise as transphobic or right wing or something? Judge slapped her down with "it's different in Scotland" when she tried to argue with him, anyway.

Aren’t most people against illegal immigration? I have friends from South Asia who are struggling with current visa requirements to extend their leave to remain in the UK. They have come legally to the UK but may not be able to stay which will be heartbreaking as they have made a lot of friends.

I reckon she'll have the support of those who are anti illegal immigration. Of which there are many.

Not sure there are that many people who are in favour or illegal immigration. The clue's in the word"illegal". What is more contentious is whether people are in support of allowing those escaping persecution to claim asylum.
