Well that's what the whole farce rests on. Once women's spaces are open to men who feel like women, they are no longer spaces to protect women, they're spaces to validate men as women. That's why dedicated unisex spaces won't do. It's got to be women's spaces or they haven't been validated.

What worries me is all the focus being on the certificate and whether you can establish if someone has one. Not being able to ask for the GRC does matter for the workability of the Act - if we accept the s9(1) - but the main point surely is that the certificate doesn't matter anyway because it doesn't make somebody into the other sex.

Lesbians are never going to be attracted to a male body. A male with a GRC is no more attractive to a lesbian than one without. And that's the crux - who do lesbians fancy? Other women. Not people with the correct documentation.

I’m reading my way through this thread with great interest - thank you everyone who’s keeping us abreast of events.

But I just needed to say that in my lifetime, there have been court cases to determine if:

  • women should be allowed remain in their jobs after getting married
  • women should be allowed enter financial agreements without their husband’s consent
  • women should be allowed have access to contraception
  • women should be allowed divorce their husbands
  • women should be allowed keep their children if they are in a same-sex relationship
  • women should be allowed access to abortion abroad
  • women should be allowed access to abortion in their own country

I’m sure there are cases I’ve forgotten but these are the really big ones that come to mind for me.

And now we have a court case that is trying to decide if:

  • women should be allowed to exist as a separate and distinct legal category from men and keep for themselves the rights they’ve won for their sex.

Its just all gets a bit much when I think of how many court cases there have been in my lifetime to determine my rights (distinct from what a man/men will allow me to have) under the law.

Technically no we haven't.
We have left the EU. We haven't left the ECHR.

The hard right of the Tories would like to do this next. Mainly because it would strip of us of the ability to uphold a bunch of rights as citizens. And would had power to big corporations and the state.

That said, if there is a ECHR ruling which we refuse to follow there's also limited repercussions if the government refuse to comply with it. EU member states could try and force us to comply by threatening with blocking other agreements or deals. But there's still a limited amount they can do if the UK government says "hmm nope, no thanks". Whether Starmer would have the balls to do that, I'm not sure but it is an option. He will be looking at Reform and the Tories who are lining up the ECHR in their cross hairs for the next election. Starmer gets to choose whether to play to their agenda or not in this scenario.

Further to that, other European countries will not all be wanting to touch this subject if they can possibly help it because they will be looking at the US and then back over their shoulders at their internal far right parties going "hmmm no maybe not. Maybe we'll just let this one slide and hope no one notices". Cos own self interest and an understanding of just how bad the optics on all of this are.

Cos politics.

I think the shark has been jumped with lady peni and pregnant men leading to a potential 'woke backlash' which is suddenly actually being taken seriously.

I hope it goes the way of women, because it's a lot less stressful and problematic in the long run, but I also think this ruling will ultimately have no good outcome for TRAs which ever way it falls.

The ship has sailed and is surrounded by those jumping sharks.

Weirdly, that actually makes me feel better. Obviously none of it should have been necessary but it's a reminder that women have been up against utter insanity before and won.
