NHS Fife tries to silence nurse

So as has been mentioned on threads about the Darlington nurses a nurse is sueing NHS Fife over its trans staff policy.
The poor nurse was forced to get changed infront of a man in the female changing facilities, when she complained about it she was 1st told to change in a cupboard if she didn't like it, then they tried to bully her into swapping shifts so she didn't work with the man in question (she wouldn't), then they wanted her to move hospital (again she refused) so then they suspended her without pay for months until her solicitor got involved and now they are trying to gag her by insisting that the court case (starts in February) must be held in secret (I wonder why) and will be in crt next month asking to restrict reporting on the case.

This case is really important in Scotland because the trans staff policy that's going on trial in this case is the Scottish government's own policy used in all public sector organisations in Scotland and works on self id. So when this case is won it will finally kill the Scottish government's self id policy in all public bodies

Judge Kemp? He did not consider my account of my emotional breakdown (following recent widowhood and my sacking) to be fully genuine, and was inclined to disbelieve the psychiatrist who diagnosed me.

Upton just hasn't behaved in any way as someone who's vulnerable and distressed by the reality of his sex and SP wanting a single sex space (which incidentally is her right under the law). He's behaved like a bully determined to lord it over all the other staff and bend the entire hospital to servicing his needs first and patients only a remote second.

How is taking notes about a personal dispute in A&E not medical malpractice? Poor patients.

Trying to police female behaviour down to eye contact is not a good look. Sounds like attempts at coercive control to me, backed up by the hospital HR.

I just keep going back to the image of all those female members of staff waiting in the corridor, while he's in the changing room - happy as Larry.

Who obviously knows full well the effect he's having on the women.
As we know, they are the prop in the fantasy.
The other men in the changing room just don't have the same je ne sais quoi.

I have a bad feeling about this tribunal. I'm not as confident as I was during previous cases.

He's probably not happy as Larry as he wants them in there with him, feeling uncomfortable and either unwilling participants in watching him get undressed or being watched undressing by him. It's gross.

He's also on there whipping out his mobile phone to record contemporaneous notes on how she reacted to his intrusion. Again, gross.

Too many people in this situation have enabled this person to validate his grievance and not one of those people has said, when they could easily have, "can you not see how this makes you look?"

You only have to look at comments on twitter and BTL on news articles about this to see that the general public view does not support women being forced to be present while a man undressed, or being forced to get undressed or deal with their menstrual mishaps in the presence of a man who makes them feel uncomfortable.

If he is a vulnerable, anxious person, they could have protected him from the inevitable and very public backlash and dearth of public support.

I think bringing up the code of conduct was a mistake because anyone who sees women as human beings deserving of human rights when hearing about all the clauses to 'treat others with respect' wonders how Dr Upton has treated SP with respect in all of this. Because he clearly hasn't.

The NHS should have single sex only and gender neutral spaces (or gender: feminine and gender: male if they want, personally couldn't care as I'm using the single sex). They have failed as an employer to meet the needs of their employees.

But failing this, if someone expresses discomfort and fear at you in their space I can say for a fact most WOMEN wouldn't be 'oh I'm going to report for bullying and get them suspended'. Most actual women with the aim to keep a collegiate workplace would try and work out a solution e.g. ok, you don't like getting undressed when I'm there, can we figure out times we can agree when we'll each be / not be there.

Of course, that kind of give and take and mutual respect doesn't work if the ENTIRE POINT is to force unconsenting women to get undressed in front of you. I.e. sexual harassment.

Let's not forget it wasn't just SP who was hanging out in the corridor waiting for Upton to leave. I wonder how long they were waiting, I'm guessing a long time....

Bringing up the code of conduct and insinuating that not staying 100% compliant and nice when feeling vulnerable and being sexually harassed is in some way a failure of your nursing duty is just revolting.

It would in no way be acceptable to have a nurse in the witness stand in a trial where she is a victim of domestic abuse or assault and say, "but were you kind? Hmm"

A nursing code of conduct presupposes a stable context in which to operate, it's not a mandated set of behaviours in every single situation you find yourself in in life FFS.

If I had been embarrassed and intimidated in a state of undress by a male colleague then I would avoid the gaze too. What is more, if they specifically required eye contact after the incident I would consider it harassment because we both would know he was doing so because he knew I had been embarrassed and was getting a thrill from that.

Ain’t that the truth. Maybe some men who are happy (or deliberately set out) to make women feel embarrassed and intimidated want to force the victimised women to look at them in order to enjoy the distress in their eyes. Maybe it is even the Piece de Resistance of their power over the women. Maybe you’d keep a diary or notes of your project and sadly note you didn’t get to enjoy their distress fully.

Bad women not allowing themselves to be completely victimised by men who wish to do so! Don’t they know they have no rights?

The nurses code of conduct also refers to people she is in a position of power over - patients. Not a colleague granted considerable power by his employer who is ignoring her boundaries.

There's a drs code to and it says similar to the nurses code so how was this dr following it

She identifies as a female I would also be interested to hear if she has had any gender affirming surgery which means she prefers to be in the female changing room as that is now her body type.

The nurse says she uncomfortable changing in front of men but the Dr could also be uncomfortable. It's impossible to please everyone!

It's also a mental health risk if you say to Beth I'm sorry your medical condition (gender dysphoria) means less than someone's embarrassment. The case would then be her suing the trust.

Unfortunately the NHS is not immune to having judgemental people who may not be supportive of Beth's life choices. Most hospitals have other changing rooms available which the nurse could have used. I would say it's the person with the issue who moves so if Beth won't get changed infront of Sandie - Beth moves.

The need to use male pronouns stinks of her refusing to accept someone else's beliefs she could have used doctor or they. Tho from the evidence it looks like she also ignored her in work which is never acceptable.

Are you saying that only trans people who have had significant surgical intervention have the right to claim access to "aligned" facilities? And that they have to disclose their medical and surgical history in order to claim those protections?

Are you saying being trans is a medical condition?

Are you saying being trans is a mental health risk?

I think all of these statements would be seen as gatekeeping or pathologising to some.

You can surely see that even your own take is contradictory and problematic?
