NHS Fife tries to silence nurse

1000 replies

Hoardasurass · 13/10/2024 09:36

So as has been mentioned on threads about the Darlington nurses a nurse is sueing NHS Fife over its trans staff policy.
The poor nurse was forced to get changed infront of a man in the female changing facilities, when she complained about it she was 1st told to change in a cupboard if she didn't like it, then they tried to bully her into swapping shifts so she didn't work with the man in question (she wouldn't), then they wanted her to move hospital (again she refused) so then they suspended her without pay for months until her solicitor got involved and now they are trying to gag her by insisting that the court case (starts in February) must be held in secret (I wonder why) and will be in crt next month asking to restrict reporting on the case.

This case is really important in Scotland because the trans staff policy that's going on trial in this case is the Scottish government's own policy used in all public sector organisations in Scotland and works on self id. So when this case is won it will finally kill the Scottish government's self id policy in all public bodies

Dr Upton was making notes as he went along about Sandie Peggie.

This feels orchestrated and deliberate on his part.

I'm following Tribunal Tweets and the way she was treated. I've followed these cases for years but it still leaves me speechless. And so, so angry.

Agreed. I'm furious. It's so obvious that S has been bullied by U and by management.

Harassedevictee · 03/02/2025 15:25

It was orchestrated from the minute SP first raised the issue of Dr Upton being in the women’s changing room.

seXX · 03/02/2025 15:25

I wonder if he kept notes on multiple people or if he was just focused on her.

Also interesting that Dr Upton is indistinguishable from any other woman but at the same time Sandie is avoiding him specifically because he's trans - how would she know?

Chrysanthemum5 · 03/02/2025 15:27

I keep getting bumped out of the live feed so I'll read your thoughts here instead.

ChimpanzeeThatMonkeyNews · 03/02/2025 15:28

Move on, Jane, for Christ's sake. 🙄

Cailleach1 · 03/02/2025 15:29

Also, it appears to be a crock from the Tribunal that based on his appearance that nobody would necessarily think Upton is a man, and not a lady.

It appears from SP’s account of conversations that the women clocked him straightaway a man (‘identifying’ as a woman) and were communication to each other that they were hoping he wasn’t going to be using the women’s facilities. A couple of women were also hanging out in the corridor with SP till he left the women’s changing room. Even when these women refused to place themselves where they would be embarrassed and intimated, he still had an impact on them. Depriving them of the comfort of their facilities, and wasting their time.

Interestingly in the previous private hearing, he wore a suit. It’s good this is all on record.

I wonder if a patient in that hospital asks for a female clinician if they would attempt to pass Dr Upton off as a female clinician.

ChimpanzeeThatMonkeyNews · 03/02/2025 15:38

Someone muttered 'that's ridiculous' to Jane talking bullshit! 😂

Signalbox · 03/02/2025 15:41

It's like being on Twitter.

"Some women look male so you should never tell a man to get out of the women's changing room"

Mmmnotsure · 03/02/2025 15:42

We are onto the some people wouldn't know if Dr U is a man or not and that you can't always tell argument from Dr U's barrister.

And that women might be challenged even though they are actually female.

But the problem there is, Why should men be allowed access to women's spaces if they are good at deception.

Ereshkigalangcleg · 03/02/2025 15:43

Well it is, after all, one of the few TRA arguments with any logic to it all, however little.

GCITC · 03/02/2025 15:44

I've been asked multiple times if I am in the right toilet. Once I turn round or speak, I can feel the woman's relief and they are generally very apologetic.

It's not harassment. Its protecting the space as female only.

NecessaryScene · 03/02/2025 15:47

By the same logic you should never check anyone's age, cos some adults are young-looking.

Mmmnotsure · 03/02/2025 15:47

This is a doctor. Is the barrister saying that because we can't always tell (which I should think is rare) that the hospital can have this man treating a female patient intimately because the patient thinks he's a woman and doesn't realise.

BananaAppleOrange · 03/02/2025 15:51

Mmmnotsure · 03/02/2025 15:18

The barrister for Dr Upton:

Poor, poor Dr Upton. He is all that matters.

Women - shut up, be kind, do what you are told, don't have any boundaries, accept anything that men do to you.

I

To be fair, that is the barrister’s job.

Rightsraptor · 03/02/2025 15:53

Is Jane scraping the bottom of the barrel? We're talking here about one individual, Dr Upton, not TW generally so how is 'not always being able to tell' relevant? Clearly, we can tell with Dr U.

And this line of questioning about physical and sexual interactions. WTF is that about - is JR implying that because SP wasn't assaulted it's all hunky dory in the changing rooms?

Exactly. I find her infuriating.

BananaAppleOrange · 03/02/2025 15:57

How many of those women-who-might-be-mistaken-as-men continue to be so when undressed?

But in any case, why is it a reasonable argument to say a man should be able to use the women’s changing room because if he was told not to he might still do so anyway.

Cailleach1 · 03/02/2025 15:59

Absolutely. It doesn’t even apply here though. It seems even the dogs in the street could tell Upton was a man. Several of the female staff were communicating with each other that they hoping against hope that they didn’t have to be subjected to his presence in their changing room. Where they would feel embarrassed and intimidated by him.

I think someone said they thought it had been just a joke that he was using the female facilities. They found out it was true, despite the discomfort of women staff.

Harassedevictee · 03/02/2025 16:01

I feel so sorry for SP that none of her female colleagues have come forward to support her. They agree with her but as we know the process is the punishment.

Mmmnotsure · 03/02/2025 16:02

Barrister: No one else has come forward to say they are uncomfortable with the changing room situation.

Sandie Peggie [I'm paraphrasing]: Well no, and as I'm sitting here it's pretty obvious why they haven't.

BananaAppleOrange · 03/02/2025 16:02

I hope NC took note of JR’s questions about code of practice, not putting your beliefs above those of others etc and asks Dr Upton them.

Peregrina · 03/02/2025 16:03

I wonder what the women could have done, which might have made the management listen? Sent a deputation of say 50 women to say it was unacceptable? Point out that there was a man's changing room?
All hand in their resignation?
