NHS Fife tries to silence nurse

So as has been mentioned on threads about the Darlington nurses a nurse is sueing NHS Fife over its trans staff policy.
The poor nurse was forced to get changed infront of a man in the female changing facilities, when she complained about it she was 1st told to change in a cupboard if she didn't like it, then they tried to bully her into swapping shifts so she didn't work with the man in question (she wouldn't), then they wanted her to move hospital (again she refused) so then they suspended her without pay for months until her solicitor got involved and now they are trying to gag her by insisting that the court case (starts in February) must be held in secret (I wonder why) and will be in crt next month asking to restrict reporting on the case.

This case is really important in Scotland because the trans staff policy that's going on trial in this case is the Scottish government's own policy used in all public sector organisations in Scotland and works on self id. So when this case is won it will finally kill the Scottish government's self id policy in all public bodies

It is a process that applies in any circumstances where one employee has made a complaint of bullying, or similar. On day 1 suspension is the right course of action. Ideally you investigate asap.

At a guess NC will try to show that the suspension was an act related to his complaint and that her complaint about the changing rooms was used as evidence that Upton”s complaint had validity.

A complaint of harassment should not always in of itself result in a suspension as the department could have kept them on separate work cycles.

It is not the right court of action to automatically suspend. Especially when the complaint is that the employee carried out a protected act.

@BananaAppleOrange it depends how candid Dr Upton was in his initial grievance/complaint. Bullying is a red flag to an employer.

It is unfortunately typical for the person who is accused to be treated without much consideration of the employer's duty of care to them. It's not at all unusual for them to be disbelieved, and even for an investigation to go looking for evidence to "prove" their guilt. Policies are not followed correctly, because the "victim" has to be believed, so the "perpetrator" is not listened to. After a while, the employer has painted themselves into a corner and feel they cannot back down, and can start to fear legal action.

Yes, they certainly know what a man is, and they appear to give any man carte Blanche to ride roughshod over women. No matter how egregious or predatory a man’s transgressions may be. Woman who loses privacy, dignity and safety gets told to FO. The witch.

By incorporating the idea of gender souls, and gender ideology, the NHS Fife hospital appears to support (if not promote) a deeply homophobic and misogynistic quasi religious set of beliefs. Contrary to decency, equality, safety or fairness. In my opinion.

Welcome back to the good old dark ages for women.

No amount of rainbows or encrustings would have been enough, though. He only wants validation via access to the female changing room, and the women in it.

To be clear I don’t have a problem with the initial suspension. That doesn’t mean I agree with anything else the hospital has done.

Sadly women are more likely to take a softly softly approach by talking to a line manager, colleagues and questioning their own response. Men are more likely to go straight to the decision makers.

The first time Sandy questioned Dr Upton’s presence and said she felt uncomfortable she should have been listened to and respected. The hospital failed her.

You would be amazed how long people can be suspended for in the public sector. Speed is not their forte.

Yes, but as SP explained to Upton, she felt embarrassed and intimidated with a man going into the women’s changing room where women get undressed and use the toilet in quite an intimate setting. I presume there is a shower too.

By using another area, would that not defeat the whole reason some men use those women’s spaces. How on earth could men who are so inclined get to embarrass and intimidate women if the women are somewhere else?
