This means it is no longer possible to have male free spaces/ services - you have to accommodate males who have a female identity or else that is discrimination on basis of gender identity.

As Dennis Kavanagh says on Twitter, this means that there can be no men's single-sex spaces either. So every woman in Australia needs to go to her nearest gay bar or sauna, and stand & stare.

Except women don't do this sort of thing. Which is why M. Tickle is never going to be the woman he wants to be.

If Gender identity has replaced sex where does that leave people who do not have a gender identity and who object to being referred to as cis? Does it mean no one can claim sex discrimination any more?

Hmm. Maybe that's true in TRA logic, but not in law? Maybe the point is that Tickle is the only one with a "female gender identity" here in law - women don't have female gender identity, but have female sex instead?

So you have actual female sexed (and non male gender identity) women and female gender identity women?

The law often seems very confused on this point - they can't decide whether "gender identity" is innate or it is the legal "gender reassignment" fiction.

It's like they know it's supposed to be innate, but keep falling back in their logic to it being a special thing that special people have that overrides sex.

What a fucked up judgement. I feel angry about it. Sal is a shero, how many people would be willing to go into this fight? With the financial implications (how is it ok that we have to rely on crowd funding to fight for basic human rights? At least we have this modern solution, it wouldn't have been possible before the internet), the stress and the sheer amount of time you have to put into it?

It tells me loud and fucking clear that the justice system is rigged against women. We cannot trust them to act fairly. They will bend their minds around biological impossibility to rule over us and it fucking stinks.

I'm not Australian but I am a woman and this affects me no matter my location. Solidarity with Sal and Australian women. Fuck the men.

Religious institutions are exempt from anti discrimination. They can freely discriminate because religion.

So the courts/legislators agree that biological sex and sex-on-paper are different, but only in religious settings? Either sex = GI or it doesn't; the law seems to be unclear. Roll on the appeal!

The Supreme court is different. She discusses the process in most of her interviews.

And if he really is legally a "woman" there's nothing to distinguish him from them? He's not legally a "male with a female identity", surely? I thought he was claiming to be legally female.

That was one of Sall's lawyer's arguments - either he's actually a woman OR he has a transgender identity. Non-binary women and women who claim to be men are accepted.

Sometimes the longer term win is worth the early loss - in fact its generally been better in these situations to have them go higher up.

This isn't necessarily true. Precisely because it's at complete odds with English law.

And you still have medical liability to consider as a driving force which I think more significant than these type of claims which will only pour sunlight and rage into women.

And there is going to be continued backlash.

We are seeing a trend towards the far right politically across the western world. This largely is via men not women who still tend to be left leaning.

But the more this happens the more women are likely to resent and abandon liberalism.

The BBC commentary is far too one dimensional and isn't reflecting what else is happening politically.

None of it good I might add.

Sex isn’t changeable, and if it’s not binary, then what’s the third sex, eh? 🙄 These people know they’re talking crap, but they’re so blinded by the good feelz they get from ‘being kind’, that they’re falling over themselves to out-drivel each other.

If Sal loses higher up, she just has to set up an app with a carefully worded qualifying thing that excludes men determined to bully and oppress women. For women AFAB and confirmed at puberty (yes, yes, I know it’s their daft language)?
